How far is someone allowed to drive to find a safer spot to pull over after you hit your sirens/lights?

do cops appreciate that? i got pulled over on a country road once and there was no shoulder at all. i had to go almost a mile to find a good spot. cop didn't really mention it. are y'all generally cool with that?

all the time. it's used as a basis for a stop if a car is driving through a bad neighborhood or if you're seen coming from a bar/in the area of bars late at night or after 2am. it's used to fish for bigger charges.

also, i have been told that if you're CC'ing you should only roll your window halfway down and they understand that as a signal that you're CC'ing. of course you still have to verbally let them know you're carrying, but is this true?

I have never heard that/this before so therefore it is a myth.

Odd that I've seen more than one video telling drivers to get out of their vehicles with the windows up and car locked if they do not wish to allow anymore than a visual search of the interior.


This jives against the practical knowledge that getting out of your car when pulled over is always seemingly interpreted as a hostile action.

If you are pulled over, dont get out of the car unless told to do so unless you want to have a cop draw down on you. Stay in the car

i saw nothing wrong with that video clip. police are allowed to use a reasonable amount of force to effect an arrest. certain segments of the population feel that any police use of force is somehow automatically brutality, no matter how much the suspect is resisting or being assaultive.

haha i couldn't believe some cop called back up on me when I had this happen. I was on a busy road, rush hour. couldn't get over to the right to find a parking lot til maybe about a mile later

And is there any way, any way at all, to determine one way or the other in court? Someone is determined to not resist, so they lie down on the ground and put their hands over their head, so then they're not following orders and cops bash in their skull. Follow orders, when they tell you to stand up (aka Rodney King) and they'll beat you until near death.

King explained his decision to flee--at a speed exceeding 110 mph--from CHP officers as resulting from a fear that his arrest for speeding would lead to a revocation of his parole and a return to prison: "I was scared of going back to prison and I just kind of thought the problem would just go away." Sergeant Stacey Koon,the supervising officer at King's arrest,concluded (correctly,it turned out) from King's "buffed out appearance" that he was most likely an ex-con who had been working out on prison weights--and assumed therefore that he was a dangerous character. Finally,it was King's criminal history that explained the decision of prosecutors to keep him off the witness stand. If King testified,defense attorneys would be allowed to present the jury with his record of arrests--a record that might influence their deliberations.

March 3, 1991: After being seen speeding on the 210 freeway by CHP officers,King led them on a chase at speeds estimated at up to 110 to 115 mph. When finally stopped,King refused requests to get into the prone position and appeared to charge one of the officers. He was beaten and arrested. King was charged with felony evading. Charges were later dropped.

King's Trouble with the Law After March 3, 1991

May 11, 1991: King was pulled over for having an excessively tinted windshield. Although King was driving without a license and his car registration had expired,King was not charged.

May 28, 1991: King picked up a transvestite prostitute in Hollywood who happened to be under surveillance by LAPD officers. King and the prostitute were observed in an alley engaging in sexual activity. When the prostitute spotted the officers,King sped away, nearly hitting one of them. King later explained that he thought the vice officers were robbers trying to kill him. No charges were filed.

June 26, 1992: King's second wife reported to police that King had hit her and she feared for her life. King was handcuffed and taken to a police station, but his wife then decided against pressing charges.

July 16, 1992: King was arrested at 1:40 A.M. for driving while intoxicated. No charges were filed.

August 21, 1993: King crashed into a wall near a downtown Los Angeles nightclub. He had a blood alcohol level of 0.19. King was charged with violating his parole and sent for sixty day to an alcohol treatment center. He was also convicted on the DUI charge and ordered to perform twenty days of community service.

May 21, 1995: King was arrested for DUI while on a trip to Pennsylvania. King failed field sobriety tests,but refused to submit to a blood test. He was tried and acquitted.

July 14, 1995: King got into an argument with his wife while he was driving,pulled off the freeway and ordered her out of the car. When she started to get out,King sped off,leaving her on the highway with a bruised arm. King was charged with assault with a deadly weapon (his car), reckless driving,spousal abuse,and hit-and-run. King was tried on all four charges,but found guilty only of hit-and-run driving.

March 3, 1999: King allegedly injured the sixteen-year-old girl that he had fathered out of wedlock when he was seventeen,as well as the girl's mother. King was arrested for injuring the woman, the girl,and for vandalizing property. King claimed that the incident was simply "a family misunderstanding."

September 29, 2001: King was arrested for indecent exposure and use of the hallucinogenic drug PCP."

What is the current law on open containers in a vehicle? It seems like people were claiming it phased out at one point but I think it is still active. Also, is there a good reason for the law. I've yet to hear a good reason for it.

(1) In the passenger area of a motor vehicle that is designed, maintained, or used primarily for the transportation of persons for compensation;

(2) In the living quarters of a motor home or house car as defined in G.S. 20-4.01(27)d2.; or

(3) In a house trailer as defined in G.S. 20-4.01(14)."


There is also a version in Chapter 18 but I can't find it.

Not really, because enforcing the law =/= punitive penalties. There are other ways to seek compliance besides a ticket or arrest.

What are your feels regarding the rulings that police don't have an obligation to respond to 911 calls, or otherwise come to the protection of an individual in danger?

that open container law thing seems kinda vague, in the instance of a "keep the glass night" type event, or growlers.

-i get that if i have beer, i have it in the unopened state and it's cool
-if i have an opened bottle of liquor and it's in the non-passenger area (trunk or something) and it's cool... (but what about a hatchback? i drive an rsx and can reach damn near to the hatch pretty easily if need be, or could toss a whiskey bottle back there and claim it's not in the passenger area, or is the entire car the passenger area, idk)
-what about a "keep the glass night" event from a bar, or if i took a growler of beer to a party and am driving home with it empty? or an empty homebrew bottle? i suppose there's no real way i can prove that i did get into the car with them empty, i could have walked out of the house with a solo cup / mug / growler filled with beer and have been taking nips, but i cannot prove that is not what i did.

this last instance makes me nervous, as i tend to do it often, as i'm assuming it'd be construed an open container(empty container?) if i got pulled over and had alcohol on my breath, even under the legal limit.

whenever i have growlers, homebrews, or keep the glass i make sure to rinse them out best i can and then put them in the back seat. no trunk since i drive a truck so i just make sure it's as far out of reach as possible.

I thought about a question for you in my trip to Maryland...

So if you pull someone over that is from out of state or just a long ways away, are you more likely to let them off with a warning if it's just speeding?

While I'm not much of a speeder I was thinking it would really suck if I got pulled over in Maryland and then had to go all the way back for court.

My date and I went through a checkpoint on the way home from somewhere that I took the glasses home from. I was plastered. The cops looked in checked my date, the driver, out. Looked over at me, very drunk with the two glasses in my lap. They laughed, commented on the fact that I still had the margarita glasses, and sent us on our way.

I had an integra when I first got to college, and I got pulled over on my way home from school after the first semester, and they threw the book at me because my back seats were down and I had all my stuff from the first semester in there. In one of my bags, they found a hunting knife (concealed weapon). In another, a completely full flask (open container) - and I mean full to the point that when you unscrew the top, it spilled out. Point of the story is that I couldn't have reached either of those things unless I was stretch armstrong, but he was able to charge me for it.

First and foremost, the above mentioned case is a D.C. decision and has no bearing on this state. If it did, most if not all agencies have rules/regulations that require officers to respond.
