The only implied consent laws in NC are motor vehicle violations. Compel is the taking of a blood/urine/breath sample without consent of the person and without a search warrant.

In NC, there is no requirement to obtain a blood/breath/urine sample after a shooting. The same goes for a person who violates their CCW Permit by having an impairing substance in their body. While it would be prudent to obtain a sample by asking, their refusal wouldn't carry any penalties.

At that point you could obtain a search warrant or if you are well versed in the pharmacological of impairing substances you could compel them to give a sample (not sure if this has been tested in the courts).

Ok, I'll bite.

Nobody has been able to identify if it was Zimmerman or Trayvon screaming.

Zimmerman, as he stated, was yelling for help. Which if for whatever Trayvon was doing, Zimmerman felt the need for help in subduing, what he at the time thought was a criminal.

Maybe this is where Trayvon reaches for his phone which he has dropped to tell his GF to call the cops. Zimmerman thinks he is reaching for a gun and shoots him

At this point, the threat has been eliminated in Zimmermans eyes, and there is no longer need for him to scream for help.

That is basically the scenario any half assed defense attorney would paint.

One of the big problems I have with all this is how the media slants the story and people pick it up and run with it.
