i did research for a kidnapping case in my legal research courses, but i'm by no means an expert...but iirc this is how it would work

kidnapping has like 4 parts. one of those is considering being held in a place against your will...another is being released in a dangerous place. so though she was "released" in a safe place (the same place they will argue she is being held against her will) it's automatic kidnapping in the 1st degree if a sexual assault occurred during the "kidnapping"

then again they may say she wasn't "released" but escaped...
and the being held against her will part would be the she said/he-she said story between her and the other stripper/lax players--where she says they were in the bathroom when the "rape"/sexual assault occurred, and the other stripper/lax players say that didn't happen...that they were in there and then got their shit/money was shoved under the door and they left.

hmm - just heard some discussion on CourtTV. They are saying that 1) the charges of sexual assault can carry the same punishment as rape. but 2) now that there is no rape charge, the DNA evidence, or lack thereof, is no longer relevant. They can pursue and indict the guys on sexual assault charges with no DNA proof. in that case, it could turn out even worse for them. The best hope, though, is that her credibility has been damaged so bad that any other testimony she gives can be dismissed as inaccurate
