Hey, my little brother put his Xbox 360 online. Well he didnt get what he wanted so he put the second chance thing up thinking it was a one day continuation of the auction. However, it sent emails to the people saying that if they wanted to buy it for their last bid we would sell. He only got 425 for it since we didnt cancel that one in time. Are we now forced to send the xbox? What can we do to close this? PLEASE HELP

Unless you put a reserve price on the auction and that reserve wasn't met, you're obligated to sell it for whatever the final price is.

How old is the brother? If he's under 18 then you're good to go...they can't do shit, cause you can't enter into a legally binding agreement as a minor unless you have parental consent.

ebay can't do shit, we bid on a brand new car once and the guy didn't have a reserve and we won with it like 4000$ under blue book. The guy wasn't happy and we never got the car.
dude they can't come to your house and make you sell it. ebay will just slap you on your hand.

worse comes to worse you loose your account...then just sign up for a new one.

Tell the buyer to blow it out his ass, and delete the ebay acount, or, if you have plenty of good feedback, jsut suck it up and take the 1 negative.

He cannot do shit, neither can ebay. They cannot MAKE you sell it, they can just annoy you.

if you didn't set a reserve, you are obligated to sell/ship it.

if not, you'll get reported and with a negative feedback, nobody will ever buy from you again (seriously)

You should be THRILLED you made a profit, even if it wasn't astronomical. Those crazy prices are time sensative, and you missed the boat. Just ship it.

geez, maybe you should read what second chance means before you click on it.

Ebay will tell you "this is a contract you have to send it blah blah blah", but really I doubt they can make you do anything. Worse thing is you'll get bad feedback or cancelled account, but unless you have an account with a reputation to keep, who cares?

That being said, selling at auction is a gamble you don't always win. Suck it up and keep your end of the deal. It's not like you're losing hundreds anyways.

(Oh, and bbehe's right. If he's not 18, ebay can't enforce shit.)

i got one from some douche after he lost a claim against me (said i sent him a broken item 5 weeks after i actually sent it to him, yeah they'll make me give you ur money back ). I've sold plenty of shit since then.

Here's the deal- you don't have to sell it to the person who did the second chance. You run the risk (most likely this will happen) of the person giving you a bad evaluation. Your brother will not have a 100% possitive rating.


That's all. Start a new hotmail account and open up another ebay name...try it again

He made a profit on it right? Why not just avoid negative feedback, wait a few months for stocks to be resupplied and buy another one. I know he wanted free $, but $ for the inconvience of not being able to play the latest video games for a few months isn't that bad a deal. He should do what he agreed to do.

I am totally opposed to people scamming others on ebay.
However, there are people stupid enough to spend 2-3 times what something is worth to have it *right now*
These people desereve to have their money taken from them - it's not a "scam"

That said, your brother should honor the contract he made and send the xbox to the winning bidder. relisting it doesn't make him a "smart businessman" it makes him a "fucking douchebag".

You fucked up. I dont mean by trying to make money on the x box, I mean you didnt work the ebay system right. You should ship the product, but next time set a reserve high enough to make the amount of $ that you want. Someone will pay it if they want it bad enough. Better luck next time.

I dunno what you paid for it originally, but $425 sounds close with the tax ... maybe a little under.

Just make sure they can't do anything do your credit via Paypal or whatever. Or they can't "blacklist" your contact/shipping information. Not sure if such measures are even in place, but read up on their website about what they can and can't do.

basically what it comes down to is a question of what is more valuable to you...

a) maintaining your reputation on ebay as an honest seller, however much feedback you have earned thus far, as well as not having to deal w/ starting a new user name. also, it does appear to be the ethical choice to fulfill the contract, so you should assess how much you value that.

or

b) making more money, however much that might be, at the expense of more of your time and effort as well as an angry buyer who thought he was getting a great deal.
