Murdock was hunting just before 10 a.m. in a shooting lane in Randolph County when he was shot, said Capt. Chris Huebner, the hunting and boating safety coordinator with the N.C. Wildlife Commission.

The boy and his grandfather, who also were hunting, were riding a four-wheeler through the area when the grandfather thought he saw a deer and told his grandson to shoot.

Murdock, who was wearing a blaze-orange vest and abiding by all hunting regulations, was shot once in the upper chest with a scope rifle, Huebner said.

"He basically was just sitting there in a shooting lane, minding his own business when he got shot," Huebner said. "The worst part is that with a scope rifle (the boy) should have been able to tell that it's not an animal. Definitely, with a blaze-orange vest, he should have been able to tell."

Murdock had attended a hunting-safety course, Huebner said.

The boy had also taken a hunting-safety course and his grandfather had a hunting license, said Gale Wilson, a wildlife enforcement officer investigating the shooting. State law allows children under 16 who have taken the course to hunt under the supervision of a properly licensed adult.

Wilson added that the boy, his grandfather and Murdock were members of the same hunting club.

The boy's name is not being released, pending a decision by the Randolph County district attorney on whether to press charges.

The Randolph County Sheriff's Office is also participating in the investigation, which Wilson said he expects to be completed by the end of next week."

I am all for hunting and if a parent wants to give their kids a gun then fine (I just hope it is a BB gun), but they shouldn't be firing at anything they even think might be living until they are old enough to know what the hell they are doing.

His grandfather should spend the rest of his life in prison, no question.

I am not sure what the appropriate punishment should be for the kid yet though. Twelve (on average) is too young to really grasp the consequences of something this serious.

shit like this is going to ruin hunting for everyone eventually. Guy at my old hunting club had the same thing happen to him, dropped his nephew off at his stand, then walked off to go to his in the early hours. Kid pops him right under the eye with a high powered rifle. Something should be done about it, but how much more can you do without screwing reasonable hunters everywhere.

If the dude was wearing a blaze vest, then I say lock up gramps and the kid.

So how frequently does this occur across the country? If infrequent, its a news story and will be forgotten in a year; if frequent, expect new regulations in place in the near future.

i have a really hard time with children hunting. i was at the doctor this week and flipped through a field and stream magazine. They had an article about children hunting and it said that more than 50% of hunters think that kids should start hunting at 8 years and younger. I couldn't believe it! I think that laws should be stricter, at least be able to drive in order to shoot a gun. Sure they can tag along but damn not shoot a shot gun.

Fuckin' shit. A blaze orange vest? What are the damn ROE's these days? I just wear a hat. There's no telling how many animals I've let walk... I don't shoot until I've got a clear view of the kill zone.

yeah, i've been hunting since i was prolly 10 or so....always look before you shoot. Even if it is a deer that I see, I dont shoot until i have a perfect shot at the kill zone. I like to minimize suffering.

It's the end of the season and they're hunting in Randolph county-good luck even hitting a deer with your car this time of the season in Randoloh Co. (Unless you're on a family farm and are baiting the land-which don't happen much around here.) Something just isn't right about this situation. There is no mistaken a 2 legged human for a 4 legged DEER.

My Dad was almost shot one time at the Caswell Co. game lands during turkey season. Two dumbass black guys "mistaked" his decoys for real turkeys. They (or other people who cant tell the difference) should have their guns, licenses and gun ownership privileges taken away for life.

I spoke with Randolph county officier today and he said there probably won't be any punishment for the grandfather or the 12-year-old. I asked him about it and he seemed to think the man killed wasn't wearing orange at all. He also said they didn't actually see the man, just saw movement and shot towards the movement in the shrubs. Still very sad.

if they did not clearly see the deer and only shot "at movement" then they should be charged with 3rd degree murder. same as running a redlight and causing a fatal wreck.

but my take on it is that if youre out in the woods hiding and killing shit, then you too are fair game.

^^^ "Brush-shots" or movement-shots should be illegal in and of themselves, although I can think of little way of enforcing this.

A dude took me hunting twice with a club in Caswell County. They would take about 20 guys in a few trucks and drop them (us) off about every 75-100 yds. along a piece of property... the leaders would go to the other end and release dogs. The dogs would chase the deer and wherever they crossed the picket they would get shot.

Obviously they only allowed shotguns... or you would think obviously... they said a few years before a father had shot at or through (depending on who you ask) a deer, anyway the .243 struck his son in the left shoulder. It was "just a flesh wound" that left him in a sling... But they decided that shotguns would be safER.

^That's called a drive (using dogs-people can be used to do the same thing) and only shotguns are allowed-although this is not a law but anyone hosting a drive knows better than to allow rifles. And even if rifles were allowed you'd have to be real damn stupid to take one.

I was told the orange wasn't visible enough for the kid and grandpa to see it. Information is always not entirely correct. I think they are getting out of trouble with the law based on the fact that they couldn't see him well and like I said earlier just shot something moving in the woods.

What does being black matter? And isn't a "decoy" suppose to look like a real turkey? I don't know much about hunting but I thought that's what a decoy was...?

Like one of the CORE rules of gun safety is never shoot at anything until you are sure of your target and what is behind it. If you are hunting you NEVER EVER shoot at a rustle in the bushes, or at anything if you arent positive of the target. It Is wrong for 2 obvious reasons. 1 being that you dont know what you shooting at, like in this case it was a person and 2 it is unethical becasue even if it is a deer you arent sure of the shot and that means you may not kill it in a quick shot. wounding an animal in hunting is unethical. Even a kid just learning should be taught that. this story may be funny if the grandpa doesnt teach the kid that lesson then walks off into the brush to take a leak and the kid puts a 30 ought 6 round into gramps new pace maker. i dont believe in gun control or stricter hunting laws, but people need to not be retarded. to bad darwinism didnt take out gramps, instead his little slugger put a slug into a responsible hunter fuckin retards
