Yeah, there were several people around Grant. He'd have needed to be as close as possible.

This shit wasn't an accident and I can't be convinced of otherwise.

Probably because unholstering a weapon (lethal or otherwise) while in arms reach of the person you are trying to contain is generally a bad idea. Never mind the possibility they could grab your weapon, but there's also the risk of simply having your weapon knocked out of your grasp by a flailing limb. And assuming he was intending to draw his taser, the most likely plan of action was to cover with the taser while the other guys finish restraining him, which means standing up and back a bit was the best choice of action.

Again, I'm not saying the guy doesn't need to go to trial and jail, but it certainly seems more likely to me that he did not intend to kill this guy.

I believe that this shooting was most likely a negligent homicide. I would like to believe that this officer thought he was drawing his Taser, but his negligence in discharge is undeniable. I think the system of training police in usage of Tasers, pepper balls, rubber bullets, beanbags, and other "less-lethal" means of subduing subjects needs to come under scrutiny. These police were in a high-stress situation with the crowd being so rowdy, but when it all comes down to it there was a negligent death.

How stupid would the cop have to be to think he was drawing his taser, since the taser is on the opposite side of the body than the hand gun to prevent situations like this.

One of the original reasons that agencies carried strong side was weapon retention. It's a lot easier to cover your weapons if they're on one side, rather than on both sides. However, since drawing and firing is almost entirely muscle memory in a high stress situation, most agencies clearly felt that having both weapons on the same side would lead to negligent shootings. It seems the BART folks didn't get the memo.
