the other guy had the right of way. they are both at the intersection at the same time, so the oncoming traffic has the right of way and you make a left turn after yielding to their right of way.

Quote :
"If one driver is going straight
while the other wants to turn left, the driver who wants to
turn must wait. The driver who wants to turn left must give
the proper signal and wait until the turn can be made safely.
Therefore, in this case, the driver who is traveling straight
ahead has the right of way. Never change lanes while you are
moving straight ahead through an intersection.
Right-of-Way at Intersections
When you approach an intersection with a stop sign, you
must come to a complete stop and yield to the traffic on the
through-street. Do not move ahead or turn until you can
proceed safely."

-NC Drivers handbook

just because the guy made a rolling stop doesn't mean you have the right of way, you have to wait till it is clear for you to proceed safely

First, you need to cite where you got that from
http://www.ncdot.gov/download/dmv/handbooks_ncdl_english.pdf

Second, you should probably include the section heading that the quote came from

Quote :
"In intersections without traffic signs or signals, the righ- of-way rules state that:"

Third, acknowledge that the last paragraph of what you quoted is from the section just below the former which is headed with:
Quote :
"Right-of-Way at Intersections"

lastly, just because the guy made a rolling stop doesn't mean you have the right of way, you have to wait till it is clear for you to proceed safely You can't take right of way until making a complete stop

Doesn't sound like the arrived at the intersection at the same time to begin with, which sort of makes dtownral's argument even more incorrect than it already was.

Fine, cite link

So your arguing that no one can proceed through a 4 way stop until all cars approaching it have come to a complete stop?

Since the same rules apply to lights that apply to stop signs concerning right of way, wouldn't that also mean that you can't proceed through a green light until all cars approaching the red light have stopped?

Also, there's no suck thing as a "rolling stop". NCSUStinger had come to a complete stop, the bad drive had not, NCSUStinger had the right of way.

I can only imagine your confusion is over this
Quote :
"you have to wait till it is clear for you to proceed safely"

Which means there can't be anyone else in the intersection, not, that if someone's approaching the intersection there may be risk and it's not safe to proceed.

Yeah his argument isn't valid, since it has been stated many times they didn't arrive at the intersection at the same time.

A rolling stop is illegal and doesn't hold up in court. If he hadn't stopped yet, he doesn't have the right of way.

^^it's pretty damn obvious that NCSUStinger was at the intersection, and stopped, FIRST.

/case closed.

Moving forward, the amount of stupidity I witnessed on my recent trip to HHI was beyond retarded so I'll just post a few choice instances:
-with lots of heavy rain during my return drive from HHI on I-95 cars were going very slow. That's all well and good, but how about you all stay in the right lane instead of blocking both lanes of traffic as you move along at a snail's pace (30-40 mph in a 70).
-when it's pouring rain and visibility is less than 100 feet a slow speed is justified. But so is turning on your fucking headlights/taillights so I can see your fucking car!
-finally, if you're blocking the left lane for all eternity I'm going to politely flash my high beams at you, and then maybe turn on my left turn signal indicator. Both are the proper methods for asking someone to clear the lane. So when you finally get over 5 minutes later and I see a pissed off look on your face you can go fuck yourself. Lean how to be a courteous fucking driver. Nothing I was doing was being rude (i.e. I wasn't tailgating).

Good god old people. Facepalm. I was heading south on Gorman st the other day, waiting to make a right turn onto Western. Green arrow turns green, two cars go, then the old lady in front of me stops. I give the gentle honk, in case she didn't see the light. When she didn't move, I honked some more and pointed to the green light. I see her get all annoyed and I could tell she was telling her passenger something, I can only assume was about how rude I was being. Light turned red. Ugh. When the straight lights went green, she cut off the dude continuing on Gorman and went straight from the right turn only lane. Friggin old people

Silver Nissan

This asshat got 3 feet from my bumper in the left lane of I40 and continued to tailgate me even though there were people directly in front of me. I slowed down, and as I did, he went around me. I then went to pass the people in front of me, and this motherfucker brake checked me TWICE in the middle of heavy traffic (I wasn't following closely, he just slammed on the brakes).

I wish this happened a mile further down the road because there was a state trooper parked on the side of the road.

if your wipers are on then actually yes, it's the law

Some SOB this morning was wandering all over the place in his lane on I-40. Also wasn't paying attention to the cars ahead of him and would fall back and speed up all the time, randomly stomping on his brakes. I was in another lane and passed him several times. He was quite engrossed with texting on his phone.

Great idea when you're driving a 5000lb Ford pick up

more of an annoyance: I hate it when two tractor-trailers come to the turnpike interchange and both of them take up both ez-pass lanes and then they both go to the left like me towards philly/newjersey wtf One of them should have taken one for the team and let me through.

ladysman3621 pwnt

but in addition to the very correct post by TKE-Teg, even if your wipers aren't on you should turn them on if its drizzling or if there is any reduced visibility (overcast, gray, road mist, fog, etc...) because its safer and there is no reason not to.

Pfft...there's this shit called Rain X. You should try it sometime. It's from the future where intelligent people realize that sometimes it doesn't make one damned bit of difference whether your windshield wipers are on in the rain or not, so long as it doesn't fuck up your ability to see.

Little bit of a late response here, but my hands have been tied. Just getting from home to work and back has been a trial. Every time it starts to spritz outside everyone points their vehicle towards mine and tries to ram me. It's amazing I have survived this long...especially since my hands have been tied.

I don't subscribe to the simpleton/cookie-cutter version of reality, where the instant moisture touches my windshield I automatically have my windshield wipers and headlights on. If it's noon-o'clock with a normal rainin' going on, and you are concerned about being able to see that guy on T-dub that uses common sense to dictate when to turn the wipers on, chances are you probably shouldn't be operating a vehicle. But rest assured, under those normal circumstances I will see and avoid YOU.

Now that everyone has been put in their place can we get back to talking about uneducated peoples' desire to text-and-drive? Also, if there is a God, why has IT not granted my wishes to give those people cancer?

On Friday I was driving down a 2 lane section of highway 49 S (towards Charlotte) cruising at 65mph. I came up on a full size Chevy diesel dualie going 60mph. I didn't come anywhere close to tailgating him, as I didn't want any pebbles being thrown up on my car from his tires. After a few minutes the opportunity came up for me to pass him on a straightaway (with the dotted line indicating a passing zone). I dropped it into 3rd, signaled my passing intentions, and floored it. Well guess what this asshole did? He decided to floor it too b/c he didn't want me passing him. I had to go up to 85mph to pass him (I think he was going 80 around that point) and since he delayed my passing there was now a car coming in the opposite direction. After getting in front of him He proceeded to tailgate me at 80, nothing but grill/headlights in my rearview mirror. Not one to be intimidated, I hit the brakes (not very hard, but firmly) to slow down to 68-69 mph. I then shook my fist in the air to him, motioning to him to go fuck himself. After a minute or so he faded back to his usual speed of 60 mph (I guess). Never saw him again.

Assholes like this that intentionally risk your life just because they don't want someone passing them (not sure how this is offensive) should be punishable by a pistol whip to the head. GD motherfuckers

My wife's car is in the shop so we took the whole family to a follow up appointment for her at Rex Women's hospital. It was raining so we headed to the lower levels of the deck to find parking. After driving through several aisles with no spots open I saw this douche:

Most of the people that use this deck are pregnant women for prenatal check-ups, or women with small children coming in for postnatal follow-ups. I think the only thing worse than taking up multiple spots outside a hospital would be double parking across handicap spots.

I am pretty sure it is illegal to not allow someone to pass you if they properly signal their intention to do so. If you had gotten in an accident because of that guy he would have been held responsible, but I doubt he would have stuck around.

I got behind a guy going 30 MPH on a 50MPH 2-lane yesterday. At one point he came to an almost complete stop to check out some fresh roadkill on the side of the road. There are a lot of blind curves on this road so there are very few places to pass.

A woman on I-40 did something similar yesterday. We were in the middle lane; I had my cruise control set on ~72, she was probably going a constant ~68 in the mile or two that I was slowly catching up to her. There was a slower vehicle in the far left lane that we were both about to pass, so I moved over into the far right lane to pass her. As my rear bumper evens up with her front bumper I notice she has sped up to match me. No problem, but there is another vehicle a few hundred feet in front of me. I speed up a few miles per hour, and she does the same. Finally I just floor it and get in front of her because I'm running out of road. At this point I'm going ~87 and she is matching my speed.

When I let off the gas my truck slows down very quickly...The thing is practically an air brake on wheels. I let off the gas and let the cruise control take over again; still set at ~72. She angrily does a Fast and Furious inspired lane change, passes me, and catches up to the next group of cars in the far left lane.

40 seconds later, still going ~72 MPH, I pass her and all the other cars in the left lane. For a long time I can see her in the rear view, but she never catches up again.

What was the speed limit on that road? I'm assuming if it was a 2 lane it would be no more than 55. If you had to exceed the speed limit to pass him, then you'd both be at fault if there was an accident.
