UAFA is legislation that would extend immigration equality to married gay bi-national couples. Various versions of this bill have been tried every couple years for the last decade and its support seems to be getting a little stronger each time. It has 124 cosponsors in the house and 23 cosponsors in the senate (according to wiki). Its best shot of passing is as a part of comprehensive immigration reform.
I love how they do the balanced reporting by having someone who opposes it speak, who says laws shouldn't be changed b/c that isn't the way the law is currently written. The particular law that prevents spouses of gay citizens in the US from immigrating is DOMA. DOMA prevents states that have marriage equality from getting federal recognition, and additionally since the federal immigration law is based off the terms like "married" DOMA excludes gays.
(*except maybe in MA where DOMA no longer applies b/c of a court ruling, but its a very recent thing so I doubt anyone has tried anything yet, but it may well be that gay spouses aren't allowed to immigrate into the US anywhere except for MA) 7/26/2010 11:41:53 PM |

Quote : | "On August 13th, as the film version of Eat, Pray, Love opened in theaters across the country, the book's best-selling author, Elizabeth Gilbert (left), announced that she will be joining Immigration Equality in Washington, D.C., to lobby Congress for passage of the Uniting American Families Act.
At the end of Love, Gilbert fell in love with “Felipe,” a dashing Brazilian ex-pat she meets while traveling in Indonesia. As the book comes to a close, Elizabeth prepares to return to New York after a whirlwind year abroad. Unexpectedly, though, she has fallen in love more than 10,000 miles away from home.
As her relationship with “Felipe” evolved, Elizabeth learned a stark fact that many LGBT binational families know all too well: She could not bring her partner into the United States, because their relationship was not recognized under immigration law.
For Elizabeth, the solution was obvious. She could marry Felipe, and, as her husband, he would be able to be with her in the United States. For LGBT families, however, that solution isn’t available ... and that fact opened up yet another chapter in Gilbert’s journey which has led to her partnership with Immigration Equality.
“For the first time in my life, I do have a soapbox,” Gilbert told reporters last week. “I do have a little bit of an ability to say something and to be heard.”
On September 30th, she will bring her voice — on behalf of LGBT binational families — to Capitol Hill.
In conjunction with her visit, Immigration Equality will also launch Engage, Lobby, Love, an online campaign to allow you — our steadfast supporters — to join Elizabeth in calling on Congress to take action on behalf of our families. You will be able to join Elizabeth, no matter where in the world you are on September 30th, in standing up for our families.
Watch your email box for a special announcement about Engage, Lobby, Love.
First, though, make plans to join us at one of our upcoming Immigration Equality events. If you live in Washington, plan to join us on Thursday, October 21st for our 2nd annual Immigration Equality reception at Mitchell Gold + Bob Williams, in D.C.’s Logan Circle neighborhood." |

On August 11th, the Immigration Equality Action Fund’s policy team debuted its training program for grassroots activists. More than 100 advocates and allies from across the country participated in our first online seminar, featuring information on how to plan and lead meetings with Congressional representatives. (If you missed the webinar, and would like a slide show presentation, or additional help planning for a meeting with your elected leaders, please email Gannon Long, our grassroots organizer.)
Meeting your representatives — in your home district — is the most effective way to build support for the Uniting American Families Act." |
Quote : | "Making Headlines: Families and Allies Speak Out
Immigration Equality’s communications team continues to keep the stories of our families — and issues impacting them — in the headlines. From telling the stories of binational families and their allies, to speaking out against Arizona’s SB1070 and weighing in on the debate over the 14th Amendment, we continue to ensure that our families are on the front page — and the front burner — of press outlets across the country.
Our recent coverage has included:
* Bringing new, supportive faith voices to the debate on LGBT-inclusive immigration reform in a recent article from Religion Dispatches; * Speaking out against proposed repeal of the 14th Amendment, in an op-ed in The Advocate; * Highlighting our partnership with Elizabeth Gilbert, in AOL News, Politics Daily, and The Huffington Post; * Telling the stories of binational families on CNN, FOX News, and in the Miami Herald; and * Talking about growing Congressional support for UAFA on Univision.

DOMA & our current immigration laws combine to create the bastard combo, not the group trying to fix it. And comprehensive immigration reform is all the more comprehensive if it fixes such problems. And DOMA wont come up for a repeal vote for at least 5 to 10 years, immigration reform will come up for a vote in the next couple of years (more likely it'll be struck down by the court as the lower court unconstitutional rulings work there way up). No reason to let a problem persist when there's a chance to fix it. 9/23/2010 5:47:45 PM |

Quote : | "Immigration Bill to Include LGBTs
Sen. Robert Menendez of New Jersey is expected to introduce comprehensive immigration legislation before the Senate adjourns this week for the midterm recess, according to Politico, and a source tells The Advocate that the legislation will be LGBT-inclusive.
“We fully expect that the Menendez comprehensive immigration reform bill will be inclusive of the Uniting American Families Act,” said Steve Ralls, director of communications for the pro-LGBT Immigration Equality.
...
The complicated legislation is not expected to move before the end of the year, but Ralls said it was nonetheless a milestone in setting the terms of the debate moving forward.
“Senator Menendez’s bill will set the stage, in this Congress and the next, for a serious debate on fixing our broken immigration system,” he said." |

http://www.washingtonblade.com/2011/02/09/immigration-talks-intrigue-uafa-supporters/
Quote : | "Immigration talks intrigue UAFA supporters
Reports that key U.S. senators have restarted talks on comprehensive immigration reform legislation have piqued the interest of LGBT rights supporters who see the discussions as a potential path for passing the Uniting American Families Act.
Steve Ralls, spokesperson for Immigration Equality, said his organization would push for a UAFA-inclusive bill if the talks lead to a comprehensive immigration reform measure.
“If a bill does move forward, we are going to be working very hard and watching very closely to make sure that it is inclusive of the Uniting American Families Act,” Ralls said.
Fred Sainz, the Human Rights Campaign’s vice president of communications, said many questions remain about the substance of the talks and when they would result in a bill, but added that HRC would also advocate for making UAFA a component of comprehensive legislation.
“We would obviously fight mightily in order to include UAFA in any immigration reform proposal,” he said.
As it was introduced in the 111th Congress, UAFA would enable gay and lesbian Americans to sponsor their foreign same-sex partners for residency in the United States. Based on numbers from the U.S. Census in 2000, passage of UAFA would impact an estimated 36,000 bi-national same-sex couples in the country that could be torn apart under current immigration law.
Supporters of UAFA have seen comprehensive immigration reform legislation as the best chance for passing the pro-LGBT measure and have been working with key members of Congress and immigration groups to make the bill a provision in the larger package." |
Given that the Senate is likely going to get redder after the next election, I'm glad they are keeping up the efforts.

They're doing a whole valentines day theme push today. Here is a story that is being shared on many blogs:
http://www.dailykos.com/story/2011/02/14/944185/-%E2%99%A5-Today,-Love-Doesn%E2%80%99t-Matter-%E2%99%A5
Quote : | "Anton and Brian's story came to my attention via Newsworks yesterday. There's is a common story I hear in my immigration advocacy. Visitor comes to America, finds a life, find love, options run out, faces deportation. In Anton's case, he came from Indonesia, and that makes his return especially dangerous. He's applied for asylum, but has not yet had it granted and the clock is ticking down. From Newsworks:
"He is triply vulnerable as a gay man who is ethnically Chinese and non-Muslim, he's less likely to be able to get any kind of protection from police or any authorities, all of whom are members of the dominant ethnicity and dominant religion," says Soloway, who noted that Anton has no criminal record.
The straight-forward solution for a heterosexual couple is get married, start the paperwork. That's not an option for Anton and Brian or any gay people. Even if they got married in a state that allows it, the Federal Government will not respect that marriage as valid. They remain, in the eyes of the law, strangers." |
Quote : | "Ironically, many can find themselves welcomed in other countries as the gay partner of a citizen, another example of the US's lagging behind other western nations in recognizing gay rights. This is the case with Glenn Greenwald, who cannot bring his partner here, but would find himself, as a gay partner, welcomed by Brazil. Glenn was recently hospitalized and my first thought was, "And if he's in the US right now, his partner can't even come up to visit." I was struck by a profound sadness imagining they were thousands of miles from each other at a time a crisis. These are times you want, need and crave the love and support of your partner." |
And here's immigration equality's call to action relating to the story to send an e-mail or written letter to your elected officials. Its super easy to send a message with their system if anyone is game for it:

Quote : | "U.S. Citizenship and Immigration Services Asks Field Offices to Put Bi-National Immigration Cases on Hold
Following up on reports from this weekend, Metro Weekly just received confirmation from Christopher Bentley, the spokesman for the U.S. Citizenship and Immigration Services, that cases of foreign partners who are married to a same-sex partner and would otherwise be eligible for a green card are on hold in light of questions about the continued validity of the Defense of Marriage Act.
Bentley writes, "USCIS has issued guidance to the field asking that related cases be held in abeyance while awaiting final guidance related to distinct legal issues."" |
The article goes on to say that the USCIS has used this kind of discretion before in other cases. Another bit of news coverage I saw on this said that, since the executive branch opposes DOMA, the judicial branch has had cases finding DOMA unconstitutional that are working their way up to the Supremes, and the legislative branch has repeal bills pending too, that a wait and see approach is what they are taking.
I wonder just how long they will keep up the wait and see approach though, since it will take a couple of years for this to reach SCOTUS?3/28/2011 4:24:33 PM |

With the ruling against DOMA this issue is largely solved. I don't have much to add to this thread, other than it's nice to have a thread come resolution and conclusion.
Likewise, the ruling against the DOMA marriage ban also cleans up some stuff from the repeal of the DADT military ban. There were some rights and responsibilities related to military couples that couldn't be extended with DOMA in place.
It does make me wonder what organizations like OutServe, the Service Legal Defense Fund, AFER, and Immigration Equality will do now that their main issues are gone. It seems like a lot of the LGBT activism will now shift from a broad variety of diverse issues, into a greater focus on the state level marriage battles.

With the end of DOMA, LGBT families will be treated the same under immigration law as different-sex immigrant families. Immigration law is complicated and there will still be barriers for some couples, but the systemic discrimination that prevented our families from receiving the same respect under the law as others has ended. Green card applications will no longer be denied solely because a couple is lesbian or gay.
Do we have to live in a marriage equality state to apply for a green card? No. If you have a marriage that is valid in the state or country where you were married – regardless of where you live – that marriage makes you eligible to apply for a green card." |

Not necessarily on topic, but didn't see another thread one on point. Figured this would be a good place since Supplanter started the thread and last posted here.
Question for Supplanter, since you work at Democracy NC and frequently use TWW as a place to further your organization's agenda, any thoughts/comments on the ongoing Civitas Institute's investigation into Democracy NC's exec. director, Bob Hall?
