lol. i do believe you can still get a ticket while driving carts drunk. but they do have a sheriff on hand most weekends to prevent drunkards from driving the carts.

bs to the DUI ticket? thats what ive heard, never actually got one. hell if you can get one on a golf cart, lawnmower, even scooter, then a go kart is fair game.

I have an uncle who lives in Tampa. My dad and I were our riding around with him at about 1 am in Clear Water about 15 years ago. It was spring break and the cops had all of roads blocked and traffic was a mess because of all of the partying going on. He was about as drunk as you could get and drove up to a cop and asked for directions. The cop couldn't even tell my uncle was wasted.

It comes down to them not having jurisdiction on a go kart track. They might be able to hit you with a public intoxication or something along those lines if you're actin' a fool, but I don't see a way in which you could get charged with a DUI. If you can find a case of it I'd love to see it.

So here's the actual DUI law:
Quote : | "§ 20-138.1. Impaired driving.
(a) Offense. – A person commits the offense of impaired driving if he drives any vehicle upon any highway, any street, or any public vehicular area within this State:
(1) While under the influence of an impairing substance; or
(2) After having consumed sufficient alcohol that he has, at any relevant time after the driving, an alcohol concentration of 0.08 or more. The results of a chemical analysis shall be deemed sufficient evidence to prove a person's alcohol concentration; or
(3) With any amount of a Schedule I controlled substance, as listed in G.S. 90-89, or its metabolites in his blood or urine.
(a1) A person who has submitted to a chemical analysis of a blood sample, pursuant to G.S. 20-139.1(d), may use the result in rebuttal as evidence that the person did not have, at a relevant time after driving, an alcohol concentration of 0.08 or more.
(b) Defense Precluded. – The fact that a person charged with violating this section is or has been legally entitled to use alcohol or a drug is not a defense to a charge under this section.
(b1) Defense Allowed. – Nothing in this section shall preclude a person from asserting that a chemical analysis result is inadmissible pursuant to G.S. 20-139.1(b2).
(c) Pleading. – In any prosecution for impaired driving, the pleading is sufficient if it states the time and place of the alleged offense in the usual form and charges that the defendant drove a vehicle on a highway or public vehicular area while subject to an impairing substance.
(d) Sentencing Hearing and Punishment. – Impaired driving as defined in this section is a misdemeanor. Upon conviction of a defendant of impaired driving, the presiding judge shall hold a sentencing hearing and impose punishment in accordance with G.S. 20-179.
(e) Exception. – Notwithstanding the definition of "vehicle" pursuant to G.S. 20-4.01(49), for purposes of this section the word "vehicle" does not include a horse. (1983, c. 435, s. 24; 1989, c. 711, s. 2; 1993, c. 285, s. 1; 2006-253, s. 9.) " |
I think the "public vehicular area" probably only applies to places like the mall where you have huge parking lots open to the public, so maybe my understanding of the law was incorrect. I really don't see how it would apply to a closed go kart track. The slick track... Is pure awesome. Start dead last and in the turns slowly bump every single other kart in the turns and spin them out. One at a time. If you get too wild the will throw the switch that makes every kart go into limp mode so that the kids you just spun out can get turned around but then it's on again. ^I say we do it. I've been twice and had a blast both times. There is a bar there too, but once you go in the bar and get a drink they won't let you race. We always do the $45 sprint race which is 21 minutes long. It's worth it though, even though the cost is kind of high.
Also, my dad and his friend rode the skycoaster at Daytona Beach in 1995. It cost them $25 per person for something that lasted about 4 minutes and they paid a girl about $20 to film them.
