The "Well democrats did it 17 years ago" argument is pretty god damn insulting. First of all they were expanding the court to meet a growing case load, which is appropriate IMO. Whereas Berger just wants to shrink the court to deny Cooper's rightful appointments and consolidate power. Not to mention he's probably pissy since a good 1/3 of his legislation gets bitch slapped down by the courts. Secondly, that was 17 years ago. I was getting my learners permit FFS. Throwing ancient history in my face is beyond insulting.

So it's a blatant power grab when the GOP does it, but a legitimate exercise in legislative authority to help with case loads and not motivated at all by politics when Gov. Hunt and the dems do it. Got it.

Dems expanded it to meet workload, the court has been expanded in similar ways at least a few times since the court was first formed for the exact same reasons. It's clear the ONLY reason Berger is pursuing the very first reduction in the number of judges is to deny Cooper his rightful appointments. The republican judge that resigned recently so that Cooper could still appoint a new judge made this exact argument.


As a lawyer I thought you would have more interesting not politicizing the court system.

Did I actually admit to being a lawyer on here? I must have had a moment of weakness, my apologies.

I just wish people would stop pretending only the other side plays politics. If the dems have no interest in "politicizing the court system," why did Gov. Cooper immediately move to appoint a dem to fill McCullough's seat? Surely not bc of politics, right?

The only reason we even know the new judge's affiliation is because the GOP legislature made judge elections partisan races in 2014 (because Berger thought it would help get his son elected). Dems moved to make judge races non-partisan circa 2004.

I know Dems play politics, they are just exceedingly less cynical about it than the NCGOP whose obvious goal is to consolidate all power to the legislature.

Final point on this issue - no, we know about a judge's affilations not bc the GOP made elections partisan again (as if the move to make them non-partisan a decade or so ago wasn't politically motivated at all...) but bc judges almost always align themselves with their party when running (and bc you can easily just search for voter registration records in NC). Have you ever seen a voter card/palm card at a polling place? Judges are always included on partisan voter cards/palm cards and regularly appear at partisan campaign events.

Yes, but these aren't the first of these types of rules, and the Falls Lake Rules are more stringent and were written later, but it's my understanding they've already been in effect for several years. I believe it's the lobbyiss and represenatives in certain parts of the Jordan watershed that keep delaying their implementation.

What's really short sighted is this will only increase the long-term cost of compliance. The EPA will eventually require the state to implement an approved plan (maybe not under Trump, but eventually. Groups can just sue the EPA or state until they comply with the clean water act.). The state WILL eventually implement the Jordan Lake rules (IMO). In the meantime, the Jordan lake watershed is one of the faster growing areas of the state. Every single McMansion development in that watershed will eventually have to retrofit stormwater controls, and often retrofits are more costly and it often pushes costs off the developer and onto the city/county/HOA/landowners, etc.

^^some parts of the Jordan Rules have been implemented, but some, like those for new development, were never implemented and have just been continually delayed (although several local governments voluntarily implemented them).

this shit with legislative districts has got to end. If there is anything we are owed, it's legislative districts that can make it through the court system and then stick to those districts for at least a handful of years. Otherwise we are in this limbo where representatives from illegal districts are continuing to serve, until the next map and election comes along, where that map will also be smacked down in court, and representatives from illegal districts will continue to serve, ....... and on and on. We gotta break the cycle.

Just an update on SB155 - the Brunch Bill, it was approved in the House yesterday 73-40 and now moves for a concurrence vote in the Senate (no vote date yet) and then, if approved, to the governor. If all goes well we may finally be able to buy alcohol before noon on Sundays in NC for the first time since 1993 (except of course at Panthers Stadium where the legislature long ago carved out an exception for alcohol to be sold at 11am...).

SB 155 - Brunch Bill - is on the Senate calendar tonight. Lots of bills though so it may not be voted on until late. Still has to be signed by the gov, but can't imagine that doesn't happen since this is a bipartisan bill. Already talked to my town board and they're prepared to vote on the ordinance at their next meeting after the Independence Day holiday!

Brunch bill passed 37-9 last night, headed to the governor now. If the governor signs today there's still a chance your county/town board could call a special meeting - 48 hrs notice needed - to approve an ordinance allowing for 10am alcohol sales by Independence Day because what better way to celebrate America.

Analysis of new GOP gerrymanders. It suggests (to great simplify the analysis) a +12% advantage to the GOP in state House and Senate races.

Considering the significant role in the democrat vote that black people play in NC, and their relative geographic density across the state, I really don't see how these will pass constitutional muster either. How can you redraw districts in a state like NC and come away with an even bigger gerrymander?

If the courts confirm that, I think it's time for them to lay the smack down. How many chances do you give them to re-draw when they obviously aren't interested in complying with the voting rights act.
