Maybe this whole idea of percent alcohol in and of itself is flawed? I used to volunteer for the Cary PD to get me drunk and test the new recruits on how to screen for alcohol impairment. I was feeling very tipsy (past the point where i would drive) but i blew under the limit the whole night (even after they upped my liquor dosage)

not much to tell... i'd go to cary pd, they'd give me and friends liquor, and field test/breathalyze us every now and then. Then a cop would DD us home.

I also had some friends who'd go get drunk on the PD dime for breathalyzer/sobriety testing practice.

Paul. We hadn't had any booze in or around my car. We walked back to where it was parked. We sat at that light for 3-4 minutes getting impatient as no more cars were going down hillsborough, either way then I took the right and that is ALL she wrote.

imo you should give the cop your license and registration then politely DECLINE any and all questions and field sobriety tests. those tests are just to give them evidence against you

this is correct. you could still end up getting arrested on suspicion of DWI in such a situation, at which point you'll have to make a decision based on how much you've had to drink and how long it's been since you've had a drink whether to blow once downtown. But you've got a much better case for an illegal arrest for lack of probable cause in such a case versus the suspect who performs all field tests. so even if you go downtown and blow .24, unless you were all over the road the evidence supporting the arrest will probably be weak and the case could get dismissed for lack of probable cause.

and there are no license consequences for refusing to perform field sobriety tests in North Carolina. law enforcement may tell you otherwise, but the field tests are designed for cops to be able to arbitrarily pick things out that indicate to them that you are impaired. couple this with the fact that you have nothing to lose by refusing them and there is no good reason to agree to perform the tests.

you can also refuse the PBT/handheld breathalyzer in NC without any consequences, though general statute 20-16.3 permits the court to consider your refusal as evidence of your guilt. unless you've had absolutely nothing to drink, though, i'd still advise against submitting to it.

Long story short... Bend over, you are guilty until proven innocent and thanks to James Crouch there is no leeway or nice judges anymore.

Also

1. try to make all excuses not to take the field test but do not out-right refuse. (they will arrest you if you refuse)
2. If they decide to arrest you... you are screwed, keep your mouth shut.. be nice and do everything they ask and maybe they'll go easy on you or let you sit long enough to sober up before you blow in the machine.

but the best method is to call a cab... because the 12k my dwi cost me between lawyer fees and insurance rates... could buy a heck of a lot of cabs

Got a lawyer thanks to some people on here actually. He was the ADA for over 5 years and has tried 1,000's of these cases. He is a state alum and seems really nice.

Paid him 500 for that first installment payment
Paid him 100 for the temporary license to the court to start driving again tomorrow
Paying he alcohol assessment people 100 bucks tomorrow at my meeting at 10AM.
Then I will be assigned classes=$
Then I will pay another 100 dollars on court date to get full license back
Then I still owe him 1,500
Plus probably 200 dollar fine if convicted, community service. Yeah...moral is UBER for 30 bucks is better than this and I am never taking my car to another sporting event again. (No joke)

^ Those are pretty typical costs. Hopefully you get acquitted of DWI and just have to pay like $50 in court costs.
Also go ahead and get alcohol classes out of the way asap.

Jesus. Alcohol convictions are such a racket. Pay for a bunch of bullshit state mandated classes that do nothing, pay a bunch of fees and fines that have nothing to do with safety.

Couldn't they just be honest and charge you $5000 and move on?

Also, never do a field sobriety test.

^ You're obviously soft on crime and probably drive drunk all the time. How else are all the people involved in the system from police to lawyers to addiction recovery specialists supposed to make an honest living if we don't impose penalties that deter people from this behavior. Luckily there are never any repeat DWI offenders - everyone is like the OP and learns their lesson after one conviction.

Well the first court date has come and gone.

The initial officer who turns out to be a C3 Trooper and unfortunately he IS located in Wake County wasn't here. he eventually will have to be as they are trying to figure out why it took 45 minutes and what happened for 45 minutes while we sat there and did nothing. I can drive full time again, so that is nice. Either way HAPPY HOLIDAYS and thanks for all yalls help!

It looks like the courthouse is getting clobbered with DWI cases, and no one has any incentive to negotiate for a guilty plea so its only gonna get worse. Hopefully your attorney will find some flaws in your case and get it dismissed.

The thing is prosecutors do not like dismissing DWI because if you get drunk later and kill someone they get blamed in the news.

Ok I am back with an update.
First court case....continued ( met the lawyer, the state trooper stanton who took me downtown was there)...so he asked for a statement from the other guy, the guy who orginally pulled me over. (His name is SERGEANT Sterling) so he is one of 7 in this area. Most counties have one, so I am not lucky like a ton of people who get pulled over at games, because he isn't from another county...this is his county. So I go to my next court date this week... The statement has been given to officer stanton to give my lawyer. This is where my rage begins...

The note although note verbatim was typed up by officer Sterling.
( Mr. _____ was in his car at the intersection of Blue Ridge and Hillsborough Street)---which is true

A W/F was hanging out the window asking if they could take a right (FALSE) Mr.___ was leaning over to listen and heard the W/F be told NO (FALSE---His window was UP and we didn't speak to him at all. At this point he was just sitting in his car on edge of turning lane)

Mr.____ went ahead and took a right anyways at that point I pulled him over (Again, I would have NEVER gone right if we had even spoken to him, asked, etc...He WASNT the one directing traffic, he was just sitting in his car)

When I pulled Mr.____ over I saw an open container of Alchohol (3/4) full, he admitted it was his (FALSE---it was the girls who I was dropping off and she even said that.)

I then told the W/F and 2 B/M to walk to their car (True which they did)

Then come the real false accusations...

I had Mr.____ blow twice and he blew a .12 and a .13 and he stated " the only reason I am blowing high is because you are holding down the button for too long" (FALSE....never did I know what I was blowing, never did I say that, ( i thought I was blowing below a 0.08 so WHY would I have ever said the reason I am blowing High...on TOP of that I NEVER knew what I blew and I do NOT believe that at all)

Mr. ____ continuously asked me to contact Jamie Hatcher who is a family friend (FALSE) I never asked to call anyone, I asked him as he had me sit in his car for 45 minutes did he know Mr. Hatcher....that is ALL I ever said (Mr. Hatcher was the head of state troopers, his mom and and my grandma grew up together and are best friends, and I lived in the same dorm with his son) so I KNOW better than try to pull the I know someone card BS.

Then 45 minutes later is where the officer who took me downtown showed up. (This is what my lawyer is trying to fight and figure out WHY I was detained for almost an hour before anyone even showed up....)

Again, pick on me all you want for getting in trouble for this but when I saw all these lies that he typed out it really has me mad. I would LOVE for him to take the stand and speak because he is LYING. We eventually will have to subpoena him. Lawyer wants to know who was really directing traffic since I "failed to obey traffic" and also why I sat for so long waiting.

What do you guys think now? =(

*that's not what i think entirely ( i do suspect there are some mostly innocent, selective memory adjustments but that is natural in any situation) but it is how it'll be spun.

Since you have a good lawyer and your case is pending it would smart to talk to the mods about making this thread disappear. Venting here is not going to help your court case, if anything it could fuck things up for you.

The officer basically said that you were drunk (+0.1) and belligerent (people out of your window, name dropping, bad driving, and beer in hand). Whatever you say will be spun as you don't remember what happened. My comment was to help you, not berate you.

A good friend of mine went in to DWI court and told the judge the reason he ran off the side of the road and wrecked was a black dog ran across the road as he was coming around the curve. Everyone laughed, and laughed, and laughed, then he was convicted.

The officer's report in my case described different clothing than in the attached photo... Guy can't even remember what I wore with a picture to help..... Still convicted.
