Long story short, my nephew got an underage drinking ticket.

His mom is willing to spend $Texas for a good lawyer in the area to improve the chances of getting it dismissed or him into a first offenders program (no record).

Anyone know of any local attorneys that are particularly good with these types of cases?

So funny story. James Crouch apparently works at this law firm now. He (Crouch) is no longer able to practice law...but he is the office manager and head paralegal. Former Assistant DA of 5+ years and knows all the ins and outs. Let him know Jake referred you - I still hang out with him. He got a friend of mine's DUI dismissed completely and did magic. He's well worth it.

You don't even need an attorney. If he has no record just ask the DA if you can do the "90-96 program". Basically he'll have to do like 10 hours of a bullshit drug/alcohol course and stay out of trouble for a year and it's dropped completely. If they are reluctant to let them do it, then you ask for a continuance to retain counsel. I still don't think you need to pay $texas but Bill Young is the best in town for stuff like this. Co-sign what ncsuallday said, with a caveat.

If he truly is a first-time offender, no need for a lawyer in Wake County. They'll enroll him in their 90-96 program called Southlight. Unsupervised probation for 12 months, $180 court costs, $250 to the Southlight program, 25hrs community service, and case will get dismissed so long as all of that is done and he hasn't committed any new crimes during that 12-month period.

With very few exceptions, there's nothing more a lawyer can do b/c Wake likes everything with proper paperwork and "by the book" now.

If he's in Durham, same basic rules apply but whether to get a lawyer is a slightly different question. Often we can get stuff done ahead of time and have the case dismissed w/o requiring the student to go through the regular process (called an "informal deferral"); that leaves them able to do the 90-96 if he gets caught again in the future.

If they want to talk about it, my office line is (919) 998-6993 -- I'll be in Raleigh for a weed case on Monday, but Marissa should be able to schedule them a consult.

I think I'd rather have an underage drinking ticket on my record than pay $430 and do 25 hours of community service

Tickets can also be dismissed if there are problems with the case. There is nothing that says you have to do any program if not guilty. I would always get the lawyer. A good attorney will drag the case out for months and see if the cop keeps showing up or even remembers the incident. If they can't answer basic questions about the incident they cant really be a witness against the accused. The cop may not even give a shit if it goes through and agree to it being dismissed if the person who got the ticket was not being an asshole.

I got a misdemeanor on my record way back when for "disturbing the peace". It was way back when Raleigh had the nuisance violation moved to a misdemeanor. I didn't get a lawyer or do the expungement program because I didn't feel like doing the hours or paying the loot. I regret it still. I've had to explain that horrible sounding "disturbing the peace" on multiple job interviews and in other situations.

Just get a lawyer. I also think any lawyer could handle this and it probably won't even take much $.

It's still on the books but I don't know if it's in the same form as when it was enacted in 2000.
