i'm currently looking for more details. the N&O states that you cannot ride under the influence of alchol also. I do like to ride at nite, no helmet cause i don't own one, w/ passenger, drinking a few beers. sooo..... we'll see how my county sheriffs reacts to this.

This is not an on-road safety belt law this is an off-road on my own property toy and the big GOV is telling me what to do. I know I shouldn't have voted for that democrat governor.

i always wore a helmet and eye protection when i had a 4-wheeler, and i never drank before i rode it. i'd OCCASSIONALLY have a passenger on the back for brief periods, and i constantly rode it in a dangerous or reckless manner.
i think this is fine for public land, but not on your own property.
realistically, if i get another ATV and end up back in NC, i won't pay this law any attention whatsoever, and i doubt anybody ever would say anything to me about it on private land (although 95% of the time, i'd be wearing helmet and goggles anyway)11/14/2005 12:21:22 AM |

the good thing is at least there is an exception for farmers & hunters. many people either ride an ATV everyday for business or ride every once in a while IE once a month or less. This law doesn't really effect them much. Its those of us like me that ride almost daily for pleasure because I happen to live where I can ride on about a thousand acres.
I LOVE the law stating 15 and younger must ride a 90cc or less. There are way to many middle/young high schoolers riding big bore ATVs and there lightweight bodies cannot even handle them. Its liking playing w/ fire or a loaded gun, someone will probably get hurt. The parents are the ones that need to responsible for these children!!!!!!

The only problem i have with this law is the fact it can be enforced on private property. Public lands, OK. So a 12 year old can drive a car in a field, or a motorcycle for that manner, but not an ATV (under 90cc w/ a helmet)?
carelessly? So wheelies, doughnuts, etc are out for my atv? I don't think so. I really don't see a crown vic following me where I ride!

Even though I agree with the points that the law makes, I still don't think they should be forcing them on adults.
I could see making kids wear helmets, even on private property. I also think the 90cc rule at age 15 is a little pointless. Most 90cc quads are tiny. I was almost 6' tall by the time I hit 15 and it would be laughable if I got on a little mini-Raptor and tried to ride it. 11/14/2005 8:01:21 AM |

its a great law. im sick of seeing kids and drunk jackasses at uwharrie tearing the place up, getting hurt, getting in the way, etc.
one drunk dipshit tried to make his own goaround while talking shit about jeeps and ended up rolling down a huge hill with his atv crushing him a few times.
another tried to pass us where the trail didnt allow, hit a tree, fell off, and his atv kept going and hit another tree.
and i dont think ive ever seen a child on one wearing a helmet like they should.
too many rednecks asking for trouble and putting everyone else in danger while doing it.

^I 100% argee grapey when one is on an ATV trail were they paid to be there or on State/US property these rules are great! And should be strictly enforced. On the other hand when someone has an area to ride for pleasure and that is on his property or his cousin's or his friend's or whatever these laws should be suspended. Many times me and my wife double up and her friend and her date double up and we quietly pudder around the land that I ride on. This is not dangerous, in my opinion, but the law states we could be fined up to 200$ for riding doubles not to mention w/out helmet and eye protection. I'm not against safety, I'm against government shoving rule after rule down my throught. This is a personal descion for those of us over 18 on how safe we wanna ride. I ain't gonna lie, I drive my quad hard and bang the hell out of it. Thats where the fun is for me. I even wear a paintball mask when riding half the time. Not only is it scary for young kids it keeps my face protected. I've never worn a helmet and not planning to start but you bet if I had a kid I'd make them wear one till the day they turned 18.

I was thinking I had heard that somewhere. I'll bet that's how they will enforce it aside from the occasional neighbor's complaint to the sheriff. Those game wardens deal with a lot more than game law.

At least you can hear 'em comin' now that the ground is covered in fallen leaves. I hunt pretty much nothing but private land, and never been stopped/questioned. Of course, I try to draw as little attention as possible by using the bow. I had some hippie fucker scare 8 deer away b/c he wanted to take a "nature walk" on saturday at PRIME TIME. The bastard walked within 8 feet of the tree my stand was in. He never saw me, and I was so pissed all I kept thinking was, "He's in 'top-pin' range."
The wildlife officers tend to stick mostly to the public gamelands, they can nail plenty of idiots out there. But they are sneaky sumbitches though. They're badasses too, most people don't realize, they've got more power and jurstiction than police, sherriffs, and state troopers. They can do everything from give you a parking ticket to seizing your truck!

yeah, if they want to, they can sieze your guns, truck, 4-wheeler, and revoke your hunting license for life for minor violations. plus they don't have the strict engagement rules that police have, since everyone they encounter will have a gun. they also dont need reasonabnle cause to search your vehicle or property. 11/15/2005 11:55:24 AM |

While on the wildlife officer subject, I have a question. A guy who I worked with this summer said that if someone were to hit a deer with their car and kill the deer, they couldn't haul it home without having a hunting license or the game warden could cite/fine me. I got screwed by a wildlife officer 2 years ago. I'm not a hunter, and have never been hunting in my life. I was riding with some friends from high school in rural, johnston county. It was about 2 in the morning and we were coming back from dropping some girl off
Well they see a dear in the road, so they turn the truck and watch it run into the woods. They think its a fun thing to do on the way home, so twice more they sweep some fields with headlights.
Next thing I know, there's a helicopter hovering over us and a tahoe with lights blazing coming up from behind. We pull over, 2 wildlife officers come up make us get out of the truck and put our hands on the hood, spread eagle. We go through a pat down, they tear the truck apart in a search.
There's an unloaded small rifle under the rear seat, they grab it and say "you boys are in trouble now.
So they keep us there for 2 hours while they decided what to charge us with. Finally, they write us tickets for "taking a deer by means of artificial light after sunset blah blah blah" which is a class 2 misdemeanor w/ up tp $1000, com service, or jail time.
The whole time they're threatening with us "we can bring you in and take your truck just as quick as you please" "hope you boys have bail money" etc We were just as cooperative as can be
we get to court later on and the officer is a total dick and refuses to drop the charge to what it should be, spotlighting (class 3 misdemeanor, like a speeding ticket). Luckily, on of the guys with us knew tom lock, the DA. He took the officer in his office, and when he came out the attitude had changed. We only had court costs and my friends kept there hunting licenses.
Oh, and on the way out the officer told us we were damn lucky and that we wouldn't get off if he ever saw us again.
my question, why does the game warden have fucking helicopters?!?? Are deer and raccoons really worth the money to fly a chopper ever night? 11/15/2005 1:06:16 PM |

u werent justspotlighting(well you might have been but how would he know), having a gun in the truck is illegal, and he charged you with the right thing. If you didnt have a gun it would just be spotlighting, and you cant spotlight at 2am anyways os thats illegal. And yes they ride around in planes and helicopters all the time looking for people doing things like this. I know many people who have been busted for this shit. A guy at home got busted yesterday for shootin bear over bait, and they took his truck and guns and took him to jail. Game wardens dont fuck around. They are sneaky bastards. My friend got charged with the same thing several years ago, and about 15 game wardens had spent the night in the woods waiting for him to catch him in the act. They are fucking crazy.

I know how the law is written, beleive me I looked it up. How they can actually convict someone in this way I have no idea, just having a weapon is circumstantial evidence. You can't convict someone of murder for a weapon, you can't charge someone for speeding b/c they have a fast car. My problem is with the law itself and the attitude of the game warden, as well as the super power and jurisdiction they enjoy.
