40 in a 25. it was on crossroads blvd by the movie theatre.
no lawyer..didnt want to spend more for a lawyer than the ticket and court costs.

well thats only 15 over, so its not too bad. My first ticket was for 16 over and the bailiff dropped it to only 9 over, so I pleaded guilty, since 9 over doesnt really do anything. PJC is precious and would be carefull when you use it. I finally had to use mine after like 6 tickets, expecially since I had my last two in the same month.
Also, I had gotten a lawyer since I had both of those tickets together and he got one dropped, but used PJC on the other. So, it was kinda a waste for me, but only like $300 for the lawyer to go in and take care of both of them while i sat on my ass. (also that included the court cost since I didnt have to pay that cuz my lawyer went in)

actually jackleg I do know about PJC's. I have used my and talked with my lawyer about them. I have had many tickets and know pretty well about how this works. The bailiff didn't drop shit. The Assistant D.A. might have.
When you go into court there will be a line of people waiting to talk to one of the assistant district attorneys. If you get into that line and talk to the A.D.A. he will almost definately reduce it to 9 over. If he won't reduce it you will go before the judge. You can either take the judge's sentence or ask for a continuance so that you can hire a lawyer.
One ticket for 9 over will not cause your insurance to go up unless you get another ticket in the next three years (including another one for 9 over.) If you think you can go three years without getting another ticket then go for it. If not, you need a lawyer.
If the cop doesn't show up the state will just ask for a continuance. I've seen it happen plenty of times when I was in court. The judge will usually give the state two continuances and throw it out on the third request if the cop doesn't show up or they forget to bring evidence or something.11/18/2005 8:02:10 AM |

here's my story: I was on a motorcycle on capital blvd near Wade ave. i was being tailgated by the car behind me and there were brakelights all in front of me. being as i didn't want to be in that situation with no doors or airbage, i quickly darted into the other lane to avoid trouble. at the next stoplight, a cop zoomed in fron of me and blocked me in. made me pull over, patted me down, etc. proceeded to curse and scream at me. said he was gonna burn me for careless and wreckless. however, he didn't have crap on me. i explained to him that i was trying to keep the rubber side of my bike on the the pavement and me off. he didn't write me for speeding or anything. the ticket says "failing to ascertain that a lane change could be made safely." I did look, and didn't do anything wrong.

Any halfway decent lawyer would get that dropped in a heartbeat. It sucks to blow 300 bucks, but it is worth it when you hear the not-guilty verdict. Just make sure the lawyer you hire knows you don't want to cut a deal and that he is willing to take the case to win.

Well, I'm trying to decide if I should use my PFJ.
If it doesn't result in points, I'm not gonna bother.
I've heard that since it was written up as a violation of the Raleigh City Code, it may not result in points, but I think that might be wishful thanking.

when i ran a stopsign and went to court, i asked for them to reduce it to either a raleigh city infraction or 9 over. the ADA glanced at me and asked "what do either of them have to do with running a stop sign?" then laughed, handed me my paper and walked away.12/2/2005 1:38:28 AM |
