dui can only happen on a MOTOR vehicle. If you're riding a bicycle (not motorcycle) then you can't get a dui... a public intoxication yes... but not a dui.

YES you can. my brother got a warning ticket from a cop a few years back he was riding up at a shopping center. the cop was really nice and joking with him and stuff, but still made his point clear.

you can get one on a horse too.

if that is the case, any violation or ticket would not affect your license since you are not required to have a license to ride a bike ... it would only be a misdemeanor

You can NOT get a DUI on a bicycle. You CAN get a drunk and orderly or a public intoxication on one. If you don't believe me go ask a cop. It was an arguement I had with someone years and years ago so we got the cop on duty to look it up.

You do not have to have a license to get a DUI. IE, if you're driving a golf cart and you're drunk.

So stop argueing with me when you don't know wtf you're talking about.

Boating While Intoxicated (BWI) goes on your driver's license and causes your car insurance to go up just like a DWI in NC as well as most other states.

the lawnmowers thing is wrong bc i know of someone that has gotten one on a lawnmower, as sad as that seems. and where did u get this information that a bwi goes on your drivers license? i think all they do is take you to jail and costs u buncha money, nothing with your drivers license.

they aren't considered vehicles, but the law might still apply. I checked my NC Crimes and my MV Law, but I hate how that crap is written...plus, it doesn't have all the recent case law so I might be missing something

yeah--the ONLY reason why i know it's in the case law is cause it was part of my homework assignment for legal research like 2 weeks ago, haha. the question was "what's weird about blahblah v. blahblah?" and the answer was he got a DWI while on a horse which was considered a vehicle by blahblahblah case law

I know a few years ago (and this came from a Marine Patrol Officer)-- you can only get a DUI on something that has a motor associated with it (moped, golf cart, lawnmower, scooter with a motor). For anything else (bicycle that you pedal, etc) you could only get a drunk in public, etc.

As for the BWI...again, this was a few years ago, in NC, it would not affect your driver's license. The way he told me, you basically just cooperate, put out your hands so you can get cuffed and stuffed, they take you to jail, process you, you pay some money, and you're done.

This was about 5 years ago, so laws may have changed since then.

You can get one on a bike, and until recently a horse. About a year or two ago the supreme court ruled you could not on a horse, because the horse would compensate.... But you don't have to have a Drivers license to get one on any vehicle, just as you can get one on a boat, you just don't lose you license, or have an insurance penalty....

^^where do you get that the supreme court said you can not get a dwi on a horse? according to westlaw the case i just cited is still good law...the statute as well. and westlaw online keeps things pretty up to date.
