The couple is due in court Wednesday to face the charge of violating a noise code usually reserved for "the shouting and crying of peddlers, hawkers and vendors which disturbs the peace and quiet of the neighborhood.''

The penalty if convicted? According to the village code: $250 fine, 15 days in jail, or
both for each day the offense continued.

Rachel Poczatek, 43, said she didn't know how to solve the problem. "Should I muzzle my children?''

Neighbor Mark Kostakis, whose wife, Angie, is listed as one of the complainants on the summons, said he began making audio recordings of the children to document the noise. He said he spent three years complaining to the village and the Poczateks.

"This is it for me,'' he said. "I don't work 12 hours a day to come home and listen to this....''

Rachel Poczatek said her children should be allowed to play outside during the day, though she does tell them to be quiet.

The notice ordering the Poczateks' children quiet described them as ""screaming and shouting'' and causing an "unreasonable nuisance.''"

learn to control your kids no doubt...or dont move in a neighborhood with a bunch of dickhead neighbors who dont realize that, surprise, kids often like to raise their voices

I like how the guy doesnt work 12 hours a day to come home to listen to kids yelling...he works 12 hours a day to come home and spend 3 years making audio recordings instead of going to the neighbors houses and being like "hey neighbor...om you know what...your kids are yelling an awful lot...could you please do something about it?"

Unless these kids sounded like rabid banshees, I see this getting thrown out in court.

I kind of want to hear the recordings... I can't imagine kids playing in a pool can make that much noise.

Yeah, I know kids can get very loud... but to be continually loud for 3 years seems odd to me.

On the other hand, there are some terrible parents out there.

I'd be suprised if it's not a combination of kids being kids, poor parenting, and crotchety neighbors...at most, 1 of the 3 will change as a result of this going to court.

I like how if my house is loud on a Friday afternoon/evening I get nailed with a ticket that racks up all kind of legal fees and shit.

At ghetto as townhouses across the street from me the residents can stand outside and argue, bitch, yell and scream at each other all hours of the day with no consequences.

I agree maybe this lady should lay down some discipline but how fucking loud could those kids possibly be??? Sounds like this neighbor is a whiny bitches. Unless those children are yelling at the top of there lungs, setting off fire crackers and such I really do not see how they can be that big of a problem

Well my aptartment complexes pool is right in front of my apt. The kids that shreik are highly annoying when I am there but I have never heard them while inside and my bed room is right next to the window

What's the difference between this and a loud college parties?

If the cops ticket the latter, they should make the parents pay the $250 fine.

three years ago, that youngest child was two years old. He's been complaining since then? Must be some very loud children. I know they can get loud, but that's ridiculous. She should discipline them, yes. Is this at an apartment? If it is, you are living close to others, you are going to hear their kids playing outside.

in florida all of the neighborhood have houses about 2 inches apart and kids are loud as fuck. our neighbors kids would be loud for 8 hours a day and it was pretty much impossible to relax by our own pool. that said, we never complained except amongst ourselves.

OUR neighbor (a different one with her own loud kids), however, complained about our terribly annoying dog who barks in the morning at the pool filter. my Dad basically told her to fuck off when she came to complain.

I can see how this would be really annoying, especially if the neighboor did nothing about it. It sounds like the guy has tried to talk to them about it and they didn't do anything other than "ask nicely" for the girls to be quiet. Little girls can have some ear-peircing squeals and screams...I wouldn't put up with it either if I was in my backyard and had to deal with it daily for three years.

I posted this because loud obnoxious neighbors is something I have plenty of experience with.
If you think someone else can hear you--shut the hell up, or at least go ask if you're too loud.
Little kids can be quite loud from screaming, and I assure you that if it's a constant thing every day, it would probably drive me to insanity.

Sure, if they are playing during appropriate hours. It's not unreasonable to ask that the kids not scream early in the morning or late at night.

It sucks to work your ass off, finally get a day to sleep in, and then get jarred awake by a screaming brat that rolled up in your nice quiet (expensive) neighborhood. But lawnmowers and edgers make the same amount of annoying noise.

Where does it say that they were making noise during inappropriate hours? Do people tend to have their kids in the pool from 6 AM to midnight? No.

And if he has spent 3 years complaining to the POA and the family, and nothing has been done about it, apparently no one else thought that they were any real problem. It sounds like one couple is complaining. Whose fault is it that he works 12 hrs a day? Did the parents pay for a pool to keep their kids inside instead of outside, being kids and enjoying it? If you don't want noise, go inside and go back out when the kids are quiet. It's not that hard.

Almost everywhere I go in public, at some point, there is a screaming kid. Grocery stores. Parks. Restaurants. Theaters. Malls. Gas stations. ETC. Yes, I think it is vastly inappropriate, a nuisance and the parent should bust the kid's ass right then and there. Do I record the noise and call the cops? No.

Sounds like an uptight neighbor to me. Had a neighbor call the cops on me when I was about 12 because I was playing basketball in the middle of the afternoon in my driveway. No yelling, she just didn't like hearing my ball bounce.

Yesterday when I went to Sushi-Thai in Cary, they had a sign at the entrance saying that for the enjoyment and safety of other diners, customers with crying, screaming, yelling or temper-tantrum children will be asked to leave.

I will be visiting that establishment much more frequently now.
