I'd like to start off by first saying FUCK the A.L.E. I got a "providing alcohol for underage drinkers" ticket because I bought the pitcher and an underage person drank from it.
I got an underage drinking ticket when I was 18 (a little less than 3 years ago). I completed the alcohol prevention class that they provided on campus and haven't got in any trouble until last night.

What's the best root to take right now if I want this erased from my record (if possible) and spend the least amount of money as possible? I don't think I can take the alcohol class again because I already took it. I also still have my expungement if that helps any.

Call James Crouch at 919-828-5778.

Unless of course you would like to fuck around with going to court 10 times for this and doing a bunch of crap to get it dismissed. http://www.manningcrouch.com/

Probably about $250 but I am not really sure. I can pretty much promise you they will save you the trouble of having to go to court for every single court date which in itself is worth the money because that pretty much kills an entire day each time you go. They will also get it dismissed.

I had a stack of nuisance party tickets all pending at one time once and they were gonna make me do 10 hours community svc for each one. I sent them a few hundred bucks and signed a waiver of appearance and like six months later got a letter saying they all were dismissed.

This is also the same lawyer that was instrumental in getting that state trooper fired that has been all over WRAL for profiling college aged women.

Hey man I may be following in your footsteps here. Last friday ONE OF THE GUYS I LIVE WITH called the cops on me for having 15 people over. Yeah, thats not even worth getting irritated over, let alone calling the cops. I got 2 drinkin tickets that night and now I am trying to figure out what to do before my Dec. 5 court date.

i would fight this, especially if you have already used an expungement / 90-96 program

go to campus legal services, explain the situation, they will give you some information
then you can setup free consultations with lawyers and find one that will actually fight for you

obviously it depends on the situation, but i have seen many instances were A.L.E oversteps their bounds, they really really want to keep their jobs, because after all, who should go during budget cuts when your entire job description is busting underage drinking...

was it a 21+ bar?
did the underage person drink from it with permission - did the A.L.E officer see you hand the person the pitcher, etc...i would talk to a lawyer and answer these questions, don't answer them on here

As much as I hate the ALE i am almost certain that they generate more revenue through fines and tickets than the costs to keep those few pigs on payroll

haha yeah i actually did with the other 2 people that were here. its cool though. were working something out right now i think. so that somewhere to live thing is up in the air right now. the 3rd person showed up and w/in an hour of him showing the cops came. the thing is it wasnt a party. it was a few friends over, i dont know if any of yall have ever been to any of my parties or not, but i would never dare consider 15 people a party. especially when all that was going on was a few people in the kitchen, 3 up in my room upstairs, and a couple in the living room. haha yeah i know it looks funny and say what you will, it doesnt really matter i was just saying i have a ticket and i was lookin for somewhere to go. 2 of the guys i live with though talked to me and said that they want this guy out and want me to stay bc ever since we let this guy move in with us we've kindof been annoyed. not that hes that bad. i guess some people just werent meant to live together. in this case, us 3 werent meant to live with him haha.

oh and we werent loud bc i didnt want to have a party, just a few friends over bc i wasnt in the mood for a party. i didnt have the music up where you could hear it upstairs, i know this bc i went out of my way to check upstairs, the front yard, and back yard for any noise, you couldnt even hear the music from the room that it was playing from bc it was so low. the people werent loud either bc it was just one of my friends from uncg and a few of her friends and none of these people are wild. it was just supposed to be a calm social gathering. thats why everyone was shocked when they came. i talked to my other room mates and they agreed that it was absurd. me and this guy just havent really gotten along for the past month and i think it was just a thing where he took a little house dispute to a legal level. and im not 19, i might need to change that. how do you do that?

you sound like a high school kid.

regardless of your definition of a "party" you should have asked the other roommate if he was cool with you having 15 people over.

and you are still only 20 years old, deal with the tickets. are you sure he called the cops? does it matter who called them? i'm sure he wouldnt have been "damn, dude's underage and drinking in my apartment. better call the cops!" if he was the one who called, there must have been a good enough reason to have.

yeah im sure. bc when someone went to answer the door he ran downstairs and was like "hey, im the one who called you guys." yeah i am underaged, im going to deal with the tickets, i never said i wasnt. yeah i guess i should have ran it by him too, that is my fault, i never would have imagined though that that few people would be a problem.
i suppose if you actually knew the guy though and the situation in the house you would perhaps be alittle less harsh but i cannot blame anyone for that. i realize that i am underage, by some of the responses im assuming that many of you didnt drink underage bc my age is being subject to judgment here. i though that i was being smart and safe by not going out and risking anything, just having a small quiet gathering at my place. but whatever. i saw this topic, thought id speak alittle since im new to tww anyways. thanks to those of you that are cool about this though.

haha , thanks for saying i sound like a high school kid. im not quite sure how you made that assumption, especially if you are drawing that from the quote you posted, i am a junior though but i suppose that doesnt change the fact that i "sound like a hs kid".

his reason goes farther back than the people over, none of us in the house have really gotten along with him since june. im assuming you dont know the whole story here so im not upset or anything, its all kind of humorous if anything. the people that live in this house know the situation so thats all that really matters, not saying your voice doesnt bc i know next time to not write about something that people have opinions on but requires more background information. you have an outside opinion which is fine, i often do the same thing when i read other peoples stories and dont know whats going on. i just think it kind of sucks when someone you live with doesnt tell you to get the people out or something.

yeah i had a few people over and failed to mention it to him, yeah thats my fault. he failed to mention to me that he was calling the cops (3 cop cars came). me not telling him about the few people didnt get him 2 charges of under 21 possession.

i'm saying that you are whining like a high school kid. "but mommm... i swear it wasn't a party, just soandso from uncg and her friends... i didn't mean to get in trouble"

haha thats funny. i actually did start locking my door though (i never have locked it before) bc i feel like he might try to do something. despite how many people have offered to do something to him, i wouldnt ever let anything happen to him or let anyone or myself do something to him, even though he did this and the other things, i cant bring myself to 'get him back' bc thats probably what he wants anyways so he can take it to another level.

i dont know if it helps you figure out what type of person he is, but he bought a michael vick jersey after vick got in trouble for the dog fighting. i apologize for anyone that is a vick fan, im sure that he is a great guy or if anyone supports dog fighting, its not my place to judge.

one time early last spring, one of our friends had both of his lungs collapse (one fell 100% and the other 80%). the kid can be annoying sometimes but is still one of our friends. Probably 2, maybe 3 weeks after the guy got out of the hospital this guy that i live with (the cop guy) was up my room and slammed the guy up against the wall by grabbing him by his shirt on his chest and picking him up all bc he said something that was annoying or soemthing. this is on camera too bc i was in the process of filming something for Pinwheel. this guy would rather show his authority and risk re-injuring someone than to hold in his feelings and be the big guy and let it all go.

regardless, despite how great it would be to drop a big one right on top of his mattress, i couldnt do it, maybe out of fear of what he would do next, but also bc thats not my game haha.

and to the post before about the highschool thing. yeah i guess it could have sounded like i was calling to mom or whatever. its cool. thanks man for the welcome.

Maybe its because I'm old now, but 15 people is definitely a party. shit, 10 people is a party.

And if you get busted by ALE, that means you shouldn't have been doing what you were doing.

if my roommate called teh cops for having a few friends over I would probably take a bat to his head. What a fucking dick. Did your roommate try to talk to you about how he didn't want people over or how you all were being noisy???

This is seriously some fucked up shit. Since he is the pro "Vick" type next time he invites is homies from the hood over to smoke a blunt you should be a good citizen and send in a tip to the narcotics department

Parsnip.

If that doesn't work, you can try a sweet potato or some horseradish.

^yeah duh, lucky this happened before the new DEC 1st Law, which would cause you to lose your drivers license if convicted. Below are the current penalties, best of luck.

Penalties
G.S. 18B-302 (a) Selling or Giving Alcohol to Persons Under 21
A violation of the statute is a Class 1 Misdemeanor. Conviction under this statute requires a mandatory fine of $250.00 and 25 hours of community service.

G.S. 18B-302 (c)(2) Aiding or Abetting Persons Under 21 in Possessing or Purchasing Alcohol
A violation of the statute is a Class 1 Misdemeanor. Conviction under this statute requires a mandatory fine of $500 and 25 hours of community service.
