Quote : | "As issued by the NC Department of Fire Resources, North Carolina Governor Mike Easley announced that the N.C. Department of Environment and Natural Resources had once again reinstated the open burning ban across the entire state of North Carolina. The move also cancelled all burning permits which had previously been issued. The ban is a result of the extremely dry conditions found across the state due to the ongoing drought conditions.
According to the North Carolina Drought Management Advisory Council web site, much of the state is dealing with an exceptional drought situation while severe to extreme conditions exist in some area. Exceptional drought is classified as conditions which may include limiting water usage so as to ensure public health and safety, and the likelihood of water rationing. Any large forest fire in the state would certainly strain the already depleted water resources.
According to N.C. General Statute law, "the ban prohibits all open burning statewide, regardless of whether a permit was issued." Additionally, no new permits may be issued. Those found in violation of the open burning ban will face a fine of $100.00 and may be faced with any associated court costs.
There are certain guidelines associated with the burning ban which do allow for certain outdoor activities. Not included in the ban are out door cooking fires including grills and outdoor cookers. The ban also does not apply to fires which are within 100 feet of a dwelling as this falls under the jurisdiction of local fire marshals. However, many local agencies have placed bans on outdoors fires such as these and you should contact your local fire marshal or fire department for information.
According to the N.C. Forest Service web site, open burning does include "burning leaves, branches and other plant material. In all cases, it is illegal to burn trash, lumber, tires, newspapers, plastics or other non-vegetative materials."" |

Not necessarily true. You can't build a fire to cook with and claim it's a cooking fire. It's only legal if it is within a contained cooking device, such as a grill. I've heard talk within the NCFS that a fire bowl does not count as a grill.
From a press release on Oct 25:
Quote : | "The burn ban does not allow for cooking fires beyond the 100 foot area of an occupied dwelling. Cooking is allowed using an enclosed grill or outdoor cooker." |
Mildew, you need to check with your local fire marshal. Some jurisdictions have banned all fire within the 100' boundary, even in grills. If your fire marshal has not banned anything, then you can do whatever you want within the 100'.11/12/2007 2:03:34 PM |
