If my neighbor backed her car out of her driveway, and hit my car parking on my front yard, that would be her fault, right? She tried to say that where I parked is "public" land, but I don't think it really matters, because she hit a PARKED car.

still probably her fault unless you were on her land, in which case it may get more complicated

I would suggest calling student legal asap if she doesnt really work with you. Good luck with that man.

Unless you have a way to prove she hit you, which I would work on getting ASAP if you can, you might be out of luck. My neighbor once backed into me and left a note, but then she started being a bitch and avoiding the insurance company, etc. They said that if she hadn't left the note I would have been screwed.

she hadn't hit me yet, but she threatened to call the police if i keep parking my car there. I think it's a bit rediculous of her to call the police, since I believe she has no legal ground for this. Btw, she lives across the street from me, so there's no way my car is on "her" land. I'm just asking to make sure that if she ever hit me in the future, it's not my fault.

Regardless of whether you're on your land or public land, she can't just hit your car and not be legally responsible. But if she wants to, I'm sure she could easily find a way to do it and cover her tracks to fuck you over.

^^ tell that slore to STFU. what are the police going to do b.c your car is parking in front of your yard. last time i checked it wasn't against the law to park your car on the side of the road in residential areas.

As long as there is no law prohibiting you from parking in the public right of way on/off the street or law that limits the amount of time that you can be parked there, your neighbor has no legal grounds for complaint -- even if you were parked in front of her house.

And if she ever were to back into you, it would be her fault for hitting a parked car.

I would give a call to local law enforcement just to ask them about residential parking regulations to double check that there are no laws in place that prohibit you from parking there.

instance where my car was hit while parked... i was told that since it was parked, and had been for a while, that it was the other person's fault (which in my case it clearly was her fault for pulling in past it to park and then leaving later only to back straight into it)

A public street is "public" land, so I'm not sure what she is getting at. I guess you can take a sledge to someone's vehicle as long as it is illegally parked. There may be ordinances or HOA covenants in place to prevent you from parking in the grass, or obstructing a sidewalk, but that has nothing to with liability from hitting a parked car. If you were illegally parked, she may be able to get you ticketed and/or towed.

By parked in the yard, do you mean two wheels were in the grass or your whole vehicle? Is it a public or private street? Are you in or out of the right of way?

Did you tell her it would not matter who owned the land if she looked behind her when she backed up? I mean what if an old lady was walking behind her and she ran over her, I guess that would be the ladies fault too.

Maybe you should tell her she can't pull her car out of the driveway and onto the street since it is "public" land.

I think we aren't getting the entire story. It seems like where you park is making it difficult for her to easily enter the road from her driveway. Perhaps you could do as someone else mentioned and park your car a few feet away to diffuse the conflict.

I mean even if he is being a complete douche about where he parks its not his fault if she hit his STATIONARY car. If she had a problem with the location of him parking a good time to voice that would have been before she ran in to his car.

I usually don't park at that spot, but sometimes my friends do. They didn't park right behind the driveway, but a few feet away from it. It's not my fault she doesn't know how to back her car out properly. The thing that pissed me off is that she wasn't being nice about it, and asked us to park somewhere else, but she left a note threatening to call the police if we park there again. Also, the car was completely on the grass, not on the street.

hgtran can you get your story straight?

I agree that your neighbor did not address this in a proper manner. She did bring it to your attention though, and you should respond to her concerns.

just an update, I talked with her again today, and she said that the car was on "DOT land", not on my yard. Also, she said that she talked to the sheriff, and the sheriff told her that if she hit my car, I'm on my own. I was like "whatever, if you hit my car, I'm taking you to court."

One thing that you should learn as an adult is to never ever take someone's word. If you want to know the legality of the situation, you should find out for yourself.

And this is straight from the NCDOT Driver Handbook:

Quote :
"

Always park on the right side of the road, except on one-way streets.

Before pulling out from a parallel parking space, check for approaching traffic and give a left turn signal, unless you are parked on the left side of a one-way street.

If you are driving and notice that a car ahead of you is pulling out from a parallel parking space, slow down and be prepared to stop.

Places where you should not park:

* at an intersection or in front of a driveway;

* within 25 feet of the curb line of an intersecting street or within 15 feet of the intersecting right–of–way lines if there is no curb;

* on a crosswalk, sidewalk or bridge;

* within 15 feet of a fire hydrant or entrance to a fire station;

* on the paved or primary–travel portion of any highway — parking on the shoulder is also against the law unless the parked vehicle can be seen by approaching drivers from both directions for a distance of at least 200 feet;

* on the roadway side of another vehicle (double parking);

* where there are no-parking signs;

* within one block of a fire or fire truck in city limits or within 400 feet of a fire or fire truck outside the city;

* anywhere within the right–of–way of an interstate highway, except in designated parking areas or in cases of an emergencies; and

* parking spaces designated for handicapped use unless your vehicle is displaying a handicapped license plate or placard. "

http://www.ncdot.org/dmv/driver_services/drivershandbook/chapter4/basicDrivingPart1.html#BD%20Parking

If you're actually parked legally and she backs into your car, she's the one shit out of luck. Now as for illegally parked, I'm not sure about that.

also, regardless of it being her fault or not, you should check with your HOA (if applicable) for any rules about where you can park, how many cars you can park in the street, etc. even if you don't know about them, they aren't posted, or whatever, you agree to them by living there.

An HOA can't restrict parking on a public street anyway. Why don't you just move your car off the grass and park on the street?

Why don't you just follow her in your car after she leaves her house one day. Wait until she parks at the mall or whatever and ram right into her car... it's not your fault, her car was on public land.

BTW. All this sounds made up.

i'm not in a HOA neighborhood, the car is definitely is in plain view, can be seen far away. The only reason you will hit the car is that you don't look back before you back out.
