devils advocate stance:
if the biker was in the wrong (and regardless of right/wrong, he probably shouldn't be riding his bike on a highway), then the lawsuit is justified. How is a biker different from another vehicle on the road? They want equal rights to ride on roads with cars, why should they be given special treatment? They should be liable for damages just as another motorist or motorist's insurance company would be in a similar situation. 1/30/2008 11:57:31 AM

^ that's irrelevant, if the biker was at fault, then the man who did nothing in his Audi (but apparently he was speeding, but was cleared of any wrongdoing, wtf) is entitled to compensation for damage
also, i assumed highway based on the posted speed limit, most of the time in the US, 55mph implies highway, but I don't know Spanish road terminology.

how could it be the biker's fault. The kid was rear ended and blatantly speeding.
