Anyone have any good lawyers they have used before for car accidents? I am not sure if I want to hire one or not, but I am thinking about talking to one. The other party has admitted it was his fault, but his insurance company is giving me the run around. Told me they will only pay up to 5,000 in my medical bills, I have a feeling they will go over 5k and I don't think I should get stuck paying for them. I did a search on google, looks like he is a defense lawyer, particularly for people driving impaired....which was not the case...the other guy hit me and totaled my car.
I have a few questions if anyone knows the answers: 1)If I use my health insurance company to cover bills, they cover some, can they later come back and say they won't pay it since it was a car accident where another person was at fault and make me pay them back? 2)The insurance co of the man who hit me said they won't pay more than 5k in my bills. Can they put a limit? Or do they have to cover my bills, within reason of course... 3)How do you put a price on pain and suffering??? If you have this many questions you should get a lawyer. I didn't get one when my truck was totalled, but I also didn't have any injuries. Given that there will be both auto and medical involved I would go ahead and get a lawyer.
Depending on what kind of coverage he has the insurance company may have a cap on how much they will pay for medical damages. If that is the case you may have to file a claim with your own auto insurance or sue him for the remainder. I don't know enough to give you advice and frankly I can't imagine anyone on here can either. Just save yourself the time and potential screw ups and get a lawyer. If you haven't already you'll get about a dozen letters from various firms in the next couple of days. 4/27/2008 8:57:49 PM |

It happened in Wake county. In the beginning I didn't think I would need to get a lawyer, but I just don't want to be stuck paying anything when this was 100% the other guys fault. And it seems like his insurance company is trying everything in their power to screw me over. 4/27/2008 9:05:00 PM |

yeah, that's sketchy as hell insurance if it only goes to 5k (as in probably doesn't exist to legally drive a car in NC). They're obviously shooting for something with that figure. Best advice for dealing with them
1.) DON'T SIGN FROM HIS INSURANCE COMPANY. AT ALL. 2.) Don't call them, get a lawyer to call them. 3.) They're not going to play nice, you shouldn't either.
Number 2 should probably be the next thing for you to do. You probably won't have huge long involvement from legal council, more than anything, you need to have it to say you have it. If anyone asks, make sure they know that the insurance is going to pay, or you're going to F them up.

the insurance trying to get you to take as little as possible, I wouldn't take 5k for it if your medical bills are more than that. Never accept the first thing that they offer you because it will always get higher from there. I'm pretty sure your insurance company can also turn around and say "you owe us money" if they so desire, rather than going the lawsuit route. I'd get a lawyer on this ASAP to save yourself the trouble. If the lawyer is any good, you shouldn't have to pay anything out of pocket, the lawyer will likely get enough from the other party's insurance to cover his/her fees. (Though it may lessen any money you would receive over/above what your medical costs end up being).4/28/2008 10:35:15 AM |

They recently won a major trucking lawsuit. Hence the truck information. However, they do handle automobile PI cases.
