the speed limit on friday. state trooper pulled him in yadkinville, 77 in a 65. he didnt have his license on him but knew his # by heart. the trooper slung him out of the car, cuffed him and took him to the magistrate. i guess its cause that guy got shot but shit, hes in college and was just driving up to boone for a friends wedding. was any of that warranted?

well it is illegal to drive without your license. its not the same as not having one, so its not a misdemeanor, so i dont know what warrants the trip downtown... but im not as up with it as i once was

I think it's just a citation. Nothing more...

Regardless, I'm sure stuff like this does happen but most of the time when people say they didn't do anything, they are lying...

my bro said he told the cop he didnt have his license, and the cop started screaming "WHY WAS IT REVOKED, WHY WAS IT REVOKED" and my brother just left it at the house. he said it took at least 5 minutes to get that straight because the trooper assumed he was driving with a revoked license.

innocent until proven guilty my ass. i mean ive heard alot of stories about fucked up cops but now im genuinely fucking pissed because they messed with my brother

with all of the highway patrol misconduct lately, I'm sure his superior officers and maybe Monica Laliberte would love to hear about that. as a side note, my wife has gotten 2 tickets for driving with a license she didn't know was suspended due to the fact that a dismissed ticket was not recorded with the DMV and no notification was sent. The first one was an inspection ticket in Wake co. and the other was a registration ticket in Robeson County. In Wake Co. the clerk admitted the mistake, but not so in Robeson. The suspended license tickets got/will get dismissed, but it still costs a bunch of money and a lot of headache to get the license reinstated.

Actually failure to carry, failure to provide, and not having a license are all the same (they are all misdemeanors). You can charge any misdemeanor on a citation or be taken to the magistrate. Being suspended or revoked is just a stronger misdemeanor (Class 1 instead of 3). yes you can be arrested for failing to carry or provide your license its just up to the cop. They all fall under G.S. 20-7. Driving while revoked is 20-28. There actions are normally based on your actions.

NO, failure to produce a license falls under Civil Failure 134 in which they can only take you to your parents but if you're over 18 they cant touch you
Cops cannot increase or decrease penalties based on behavior because of Latrell vs. Hockney decision in 87

yeah yeah i got dat knowledge

Oh certainly, it doesn't justify any of it.

They'll still be a dick if you're a dick though, just like any normal person.

so when a cop causes you bodily pain and has no right to do so its ok because its "not that painful"?

^ i think legally the cop had the right to cuff him and do what he did.

But, it's a complete dick move, especially if your bro wasn't doing anything else.

he was 20, had no alcohol in the car, no drugs in the car and was going 12 over. for fucks sake they have a computer system and can bring his id up with his driver license number which he knew.

been pulled twice for speeding

once for 65 in a 45 and another time for 80 in a 65.

verbal warning both times.

if you're nice to the cops, they're almost always nice to you.
(plus the star of life on the back of my car seems to help too)

I got a ticket two years ago for speeding and I forgot my license at home. The cop made me call a friend to drive me home leaving the car there... He still cited me for not having the license on me. Another time, I got pulled for illegal tag placement on the bike and again forgot my license, but I was 1/2 mile from my house and had the cop follow me. He checked my license and just gave me a warning.

Some days, I just forgot to take my wallet. It's not like it's the end of the world, although I haven't been hassled by cops in 2 years.

hmmm. i got pulled for 15 over without my license on the way back from a trip to the park. (left it at home, park is a mile away and I just decided not to take my wallet)... I got a warning.

Cops only do shit to you (within their legal means) if you are a dick...

So I ask you then:

No i'm saying he shouldn't be a bitch. The handcuffs were a little tight and caused a small amount of pain no big deal.

It is officer's call. You can be arrested if you have no photo id to prove who you are. Sorry for your bro man.

[no]

you can get arrested if you dont have your license when you are driving

that is vastly different than getting arrested for no photo id although i wouldnt be surprised if that was an offense in our lifetimes the way the federal government is going

Did he have proper cuts into his wrists or anything more serious than a bruise? Did he have any injury to any muscles or to any of his bones as a result of being arrested?

If it's a little nick and a bruise or two you really can't complain that much. If he caused your brother actual bodily injury then you might have reason to file a complaint against the officer, but really the best thing to do is to let it go. The officer got a bad vibe about your brother for some reason, decided to haul him in to teach him a lesson, and the issue is now past.

You really don't have the power to do much of anything at all in this situation besides do the equivalent of bitching on the internet (i.e. file a complaint about the officer).
