The difference here is that these kids were not charged with a crime. The secret service investigated and decided there was no reason to charge them. Had they committed a crime and been charged I doubt they could apologize their way out of it.

I think that most were saying that you don't necessarily have to do something illegal to get booted from school. You only have to violate the code of conduct (which you accept when you enroll at NCSU). Enforcing that code of conduct up up to the school's discretion. They decided not to enforce it.
