At what point have you crossed the line when having a party? My immediate neighbors are still in college and like to have parties on the weekend. Our landlord has strict rules against parties in his lease agreements but I never say anything because it is the weekend and I understand that's just what some college guys do. But the last couple of parties have lasted until 4am and involve standing on the roof of the building right outside bedroom window and dropping f-bombs, fights, the random beer can trash all over the building and parking lot downstairs and vomit all over the hallway, stairs, and some cars in the parking lot. Additionally I am tired of hearing one of the guys beating on his g/f of the month.

Is it time to tell the landlord and start calling the cops on these bastards?

call the cops, but tell them that someone is waving a gun around and threatening to shoot

that will get them there with the quickness

if the party has a lasting effect on other people's living environments, through vomit and litter, then it's fair game to bring the hammer down.

This has nothing to do with parties, and everything to do with the fact that these guys sound like grade A assholes.

I called the police on a domestic disturbance with his last g/f. There arguments were trending in a progressively worse direction culminating when she found out that he was slepping with two other girls. At which point he was throwing her against the wall and said it was her fault. I also heard her punching him. In came the cops, I wasn't gonna stand for that shit.

His current g/f is still in the "giddy" stages and has not learned what an asshole he is yet. So they are not arguing. They will and if he touches her, then in come the cops again. I would love to go crack his skull but would rather not get too involved as any negative police report against me for battery for punching his face in would most likely cost me my job at the power plant.

Q: is it interrupting your quality or life/sleep?
if the ans is yes, then yes contact your landlord.

if its not don't...

just b/c they are college kids doesn't warrant the lack of respect to others.

i think clauses like that are illegal in lease agreements

a lot of landlords put in things that they aren't allowed to and you don't have to adhere to

Landlords can put whatever they like into their leases, regardless of legality. Especially around state, they like to.

Doesn't make it any more legal or enforceable just because it's in the lease. State law > lease agreement

they do it b/c most college kids don't know the first thing about real estate law (enter captain obvious).

most folks just adhere to it out of fear.

so, if I get this right, a signed contract between two parties is not a binding document in this case? How does the owner establishing the criteria for the renter's use of the property in exchange for monetary compensation infringe on their rights?

When the law enumerates what restrictions landlords can and can't impose on their tenants, correct.

No, but it basically limits what landlords can and can't enforce, and outlines the lease. As far as rental law goes, NC's is very renter friendly. Might have something to do with the state's military population

most laws regarding parties, i.e. sound ordinances, are on a county by county basis. However, they are all pretty clear in the fact that if the party is disrupting your ability to enjoy the peace of your domicile, then it is unlawful

And whether or not the law specifically addresses behaviors like partying wrt leases...what's the landlord going to do?
Up the rent? Nope, can't do that.
Evict the tenant? Not on those grounds.
Keep the security deposit? Only if it's justified, or they don't fight.

^and that's what's more relevant than some bull the landlord has included in the lease.

you can be evicted for something (with the exception of a very few things) if the lease says you can be evicted for it

you'd be surprised how weak leases are when it comes to landlord rights. Eviction is expensive

O rly?

I'm looking it up right now, and I hate legalese, but that makes no sense.
Were that the case, if it's in the lease, your landlord could evict you for wearing purple

And no matter the case, the landlord has to go before a judge to get your ass evicted. That right there cuts down on a good number of frivolous things.

As I'm reading, I find that landlords can evict for any criminal activity that 'threatens the health, safety, or right of peaceful enjoyment of the entire premises'


And while this fella's behavior does sound criminal...'no parties is agreed upon in the lease' isn't necessarily true.

VI B...I have always missed that.
However, unless the landlord lists that in the lease as something punishable by eviction, no, he can't.
i.e.,
[list of prohibited actions] punishable by eviction: can evict
[these things are prohiibited]: can't evict.
