makes me reconsider my aversion to NC being a contributory negligence state.

Basically, extremely drunk fucker falls on subway tracks in NY. Gets run over and loses a leg. Jury awards him 2.3 million dollars, saying the subway train driver was 65 percent responsible because he could have stopped in time.

the fact that he was drunk makes me think he deserved to lose the leg due to stupidity

had i been on that jury, i'd have refused to give him anything

In NC, the drunk could have gotten much more because even though he was contributorily negligent, the subway driver had the last clear chance to avoid the accident.

I wish I knew what I was talking about. In reality, I am a blathering idiot.

He shouldn't have been awarded even one penny.
He should've had to pay for 100% of his own medical costs, for the rest of his life.
He should've had to pay to repair any damage to the subway or track.
He should've had to pay for lost subway business during repairs.
He should've been sued by the driver for emotional distress, and have had to pay for the drivers' therapy.
He should've been charged with public drunkenness, prosecuted, found guilty and sentenced.
But, instead, he gets millions of dollars.

Most american laws have truly ceased to make any sense. This crap has to stop.

Does anyone disagree that him having simply been killed by the subway would've been better?

So if instead of it being a drunk person it was huge (person-sized) chunk of steel on the tracks, I guess everything would have been ok.

There are no subways in NC.
