any way to beat this after the insurance people denied my claim. bitch ran a red light at walnut and meeting street and 6500lbs dont stop quick. claiming since i hit her in the side its 1% my fault and im not getting anything for my bumper. hardly noticeable dent at the fog light but the trucks new to me and i want that shit fixed. 2/12/2010 9:42:47 PM |

I believe you'll have to wait for the arbitration hearing to review the case. An agent from each insurance co. will plead their case and the panel will make their decision within a week, unless the hearing is extended/rescheduled. Until then, you just have to sit tight and wait it out. If you are cleared of contributory neg., then the other ins. co. has to cover your claim. If you are not cleared, then you are SOL unless you pay out of pocket. You can pay out of pocket now and hope that you win and just forward the bill to the other party's ins. co. afterwards... If it's that important to you to get it fixed.

that's a big loophole for insurance companies to deny claims under, unfortunately. it was legislation created to curb fraud, but it's also ended up screwing people out of real claims. let your insurance fight for you, if you've got a legit case (and comprehensive coverage) they'll go to bat for you because they don't want to pay, either. 2/12/2010 9:49:02 PM |

a lot of times insurance companies will just cover you if you bring up the threat of arbitration because of the legal expenses they have to endure to go into arbitration. claims have already been denied on her insurance (nationwide) and my comprehensive (also nationwide) will cover it with a $250 deductible, but if i get it fixed for the $250 BUT I have to use my Accident Forgiveness which you can only use once every 3 years and i would hate to do that for how minor the damage is. so between bullshit laws and nationwide's policies its seems im SOL.
