My landlord hasn't cashed my last 4 months of rent checks. I keep asking her, and she keeps saying she will, but never does. I'm moving out in a month and a half and it's quite likely she wont have cashed anything by then. Is there ever a point where the checks are no longer valid? There is a reason how whenever you try to withdrawal money from your brokerage account or transfer money, the bank conveniently takes a couple days to "process." In the reverse situation where the bank is taking your money or if you owe money they expect immediate results.4/8/2010 6:14:14 PM |

I had a landlord like that. All of my roommates would write me checks and I would give her a check for $1800 every month.

Agreed with talking to landlady and saying "I need these cashed before I move out". That's a first step and SHOULD be done anyways if you plan on getting a deposit back of any sort.
Otherwise, as has been stated, checks doesn't necessarily have an expiration, nor do banks pay attention to when its dated and depending on the bank, can get cashed early. Putting a STOP on each of the checks is going to be costly ... to the tune of $100+, and a STOP is guaranteed forever.
Again, go talk to her, and heck, offer to cash the checks and pay in cash. Much easier for you and her at the end of the day. She can still choose WHEN to deposit the cash.

A stop on the check will get you in trouble. I'd advise against that. I'd just call her and tell her if she doesnt cash the checks soon, when she does, they will bounce. Its not illegal to threaten her with stop payment, or closing the bank account. 4/8/2010 11:05:45 PM |

I've found that my bank (wachovia) will not take a check dated 1 year in the past.

A check is valid forever once it is written. However, a check becomes "stale" after 6 months(a very few banks may be different,but generally it is 6 months) and the bank can refuse to honor it. But if a check goes through over a year later and the funds are withdrawn from your account, there is not much you can do. Though, depending on the bank, they might try to contact the payee's bank and get the money back if you catch it in time. I would but a stop on the checks after you move, so it doesn't bite you in the ass later. 4/11/2010 7:05:23 PM |
