My landlord hasn't cashed my last 4 months of rent checks. I keep asking her, and she keeps saying she will, but never does. I'm moving out in a month and a half and it's quite likely she wont have cashed anything by then. Is there ever a point where the checks are no longer valid? I don't like having thousands of dollars in my my checking account.

If she doesn't cash them by the time you move out, put a stop payment on each check. That'll show her.

A check is "stale dated" after 6 months, but it can still be cashed.

Basically, the checks are good for forever, but after 6 months your bank may choose whether or not to honor the check.

There is a reason how whenever you try to withdrawal money from your brokerage account or transfer money, the bank conveniently takes a couple days to "process." In the reverse situation where the bank is taking your money or if you owe money they expect immediate results.

I pay all bills with the billpay service online from my bank. The checks they send out say they're valid for 30 days.

I had a landlord like that. All of my roommates would write me checks and I would give her a check for $1800 every month.

She would cash all of them together every 3 months or so, so I'd have to sit around with $5400 in my account knowing that it was somebody elses.

^^Why not just deposit your roommates' checks and have your bank draft a bank check? It withdraws immediately from your account, and the landlord can cash whenever he pleases.

Because that's a logical, thought-out solution to this problem, but most people can't turn that corner by themselves.

Agreed with talking to landlady and saying "I need these cashed before I move out". That's a first step and SHOULD be done anyways if you plan on getting a deposit back of any sort.

Otherwise, as has been stated, checks doesn't necessarily have an expiration, nor do banks pay attention to when its dated and depending on the bank, can get cashed early. Putting a STOP on each of the checks is going to be costly ... to the tune of $100+, and a STOP is guaranteed forever.

Again, go talk to her, and heck, offer to cash the checks and pay in cash. Much easier for you and her at the end of the day. She can still choose WHEN to deposit the cash.

A stop on the check will get you in trouble. I'd advise against that. I'd just call her and tell her if she doesnt cash the checks soon, when she does, they will bounce. Its not illegal to threaten her with stop payment, or closing the bank account.

do you mean cashier's checks? aren't those a couple of bucks extra?

you could do a money order, as well...they're only something like $0.25 or $0.46 from wal-mart (probably a bit more expensive other places, though)

how hard is it to cash a damn check, or deposit into a bank account... unless she doesnt have a bank account and doesnt want to pay the fee for check cashing... but in that case just get a prepaid visa... confusion

depends on the bank.. some do it as a free service, some charge a few bucks for it

^my bank has chosen to waive the fee for me whenever i've needed one. and even if it is a few bucks it's worth not having to wait around for your slack ass landlord

Thanks for the advice. I think I'm going to go with BobbyDigital's advice. I've been meaning to switch to a credit union for some time now.

I've found that my bank (wachovia) will not take a check dated 1 year in the past.

Regardless of whether or not the checks become invalid, you owe the money for rent and have to pay it at some point (and can be sued for not paying it)

A check is valid forever once it is written. However, a check becomes "stale" after 6 months(a very few banks may be different,but generally it is 6 months) and the bank can refuse to honor it. But if a check goes through over a year later and the funds are withdrawn from your account, there is not much you can do. Though, depending on the bank, they might try to contact the payee's bank and get the money back if you catch it in time. I would but a stop on the checks after you move, so it doesn't bite you in the ass later.
