I just had a background check completed on myself b/c im applying for a new job, and found
out that when I went to court 5 years ago to contest an expired registration sticker on my car. the DA had the case thrown out, I paid the court fine.

So why is it that 5 years later Im still finding this car fine on my record, and it says "Criminal Conviction" on my record for a god-damn expired registration tag which was dismissed and thrown out of court?? Do any of you know how long this will stay on my record or do i just need to pay an attorney to have it taken off? And im guessing I have to put this down every time I apply for a new job even though it was thrown out of court??

-or is it like some certain time frame things stay on your record no matter if it was a thrown out registration sticker or something else more major.do they all stay on your record for like 10 years or something??

Question: what do you mean by "da had the case thrown out, I paid the court fine"? IIRC, if your shit is dismissed (I assume this is what you mean by 'thrown out'), you don't pay court costs.

Sounds like if you paid court costs, the case wasn't actually dismissed.

that is why I said unless he plans to do something dumber soon

it's not like you can expunge anything, it's pretty limited:

http://expungement.uslegal.com/expungement-of-criminal-records/north-carolina-expungement-law/

nvm you can't expunge motor vehicle cases:

Quote :
"Disqualifications:

* Having had an Expungement already. You are entitled to one Expungement in your lifetime in NC.
* Having a conviction for a misdemeanor or felony previously.
* Having pending criminal charges.
* The charge being a motor vehicle violation.

"

To: Ambrosia- When I previously stated the, case was thrown out I mean,
while waiting for my case number to be called by the DA back in 2005, the DA reviewed the ticket written by the cop who stopped me for having an expired sticker on my license plate(this was b4 NC went to the new system), the DA informed me that my case would be thrown out b/c I did not have any prior convictions and that all I would be responsible in paying would be the court cost and I would NOT have to pay the ticket.

So i took the ticket to the clerk of court as the DA instructed paid the court costs which ended up being the same cost as the ticket, so i paid $75 bucks in court cost, and didnt have to pay the $75 fine for having an expired registration sticker on the back of my car and I thought that was that.

But as of 2 hours ago, I decided to pay for one of those services which does back ground checks and it still had the incident on record and I thought it would be long gone, since the incident was taken care of five years ago.

So tell me more about "expungment", it really cant be expunged if it is an minor infraction involving my registration sticker?

Your best bet is to go talk to student legal services if you're still a student, or go talk to someone down at the courthouse.

....what sort of job is going to keep you from working for them with some simple traffic convictions on your record. Regardless of however it was resolved.

I am pretty sure that Police depts don't care if the people they hire have a speeding ticket or two (or expired registration; whatever) , the FBI doesn't care, The SBI doesn't care, the US State Dept doesn't care.

If you are actually worried that the place you are applying is going to care about this; don't.

My thing was all of the positions that I have applied for in the last two months, when they ask the question "Have you ever been convicted of a crime", and I have always checked no,

but now that Ive found about this traffic crap still on my record which I thought was taken care of back in '05, im wondering if I have to go contact EVERY single place and explain the traffic incident so they wont think I intentionally lied on these various job applications.

Nah, cause most of those places will also have a sentence that reads something like (excluding minor traffic offenses)

Don't worry about that.

basically they're asking about convictions for misdemeanors or felonies not traffic bullshit.

Hell I'm surprised that came up on a criminal background check at all. I've had several done for jobs and apts and stuff and none of my past traffic violations ever came up.

Yeah, ambrosia1231's right -- that's not the same as the case being dismissed / thrown out.
You got shafted, also -- Both times I got an expired registration ticket, I just showed my newly gotten registration and the case was dropped, with zero cost. (except parking, lol)

You could get it expunged, I'm pretty sure... but I'd only do it if you really think it's worth it.
And what ^, ^^ said.

That's kinda weird that it actually shows up on your record. None of my infractions of similar nature show up on mine. Also:

Same thing happens to me all the expired inspection or tags show up on my background checks even though I did the whole bring proof you got it done and we will throw it out stuff. Some of mine are more than 5 years old so who knows. This has never stopped me from getting passes onto military or govt facilities though so I wouldnt be too worried about it. Most of those are asking if you have been convicted of a felony or very least a misdemeanor.
