I heard from someone that something has changed with the process of getting a ticket for failing to stop.

A family member recently got a ticket for this. Usually I would get any lawyer to take care of this in court for us, but we have not received any legal advertisements for this. Seems like something is different. Should I go ahead and get a lawyer, pay the fees and get it over with? Or is there something else I should know?

did they get a moving violation or a ticket for breaking an ordinance? if its not a moving violation there is no reason to get a lawyer.

I got a ticket for rolling through a stop sign - failing to stop at a duly erected stop sign. It does count as two points on your license. It will make your insurance go up if you don't get a PJC. I paid an attorney 300 bucks and it was taken care of.

It was "failing to stop at a duly erected stop sign." The officer issued it on a pink uniform citation paper.

Should I get a lawyer? And are legal advertisements sent to your home address forbidden now? I would have expected to be swarmed by now.

My wife got one of these in Wake Co. She had to go to court on her court date and ask for Prayer for Judgement. She had it granted and it's now wiped from the record...assuming we don't get another moving violation for the next three years.

Was a huge pain, but just take off work on your court date, show up and use the PFJ assuming you have one to use.

Prayer for judgements are kind of risky right? What is the downfall? Is the only other option to get a lawyer and hope to get it reduced? I won't mind paying the 3-400 dollars

I had to use a PJC when I got ticketed for this because there is nothing that this violation can be "reduced" to like a speeding ticket....and I think it is 3 points on your record if I am not mistaking

they can reduce it to a non-moving violation and you don't get any points, or at least they could a few years ago when i got mine reduced and got no points

Does this mean that getting a lawyer will be no better than admitting guilt and paying the fine? If it can never be reduced, am I paying a lawyer more for something that I can do myself?

Again, what is the consequence of a PJC?

^^I think that depends on the county the ticket is in. A lot of counties won't reduce moving violations to non-moving violations.

PJC is prayer for judgement continuance. Assuming you haven't used one in the past 3yrs, and it seems you haven't, you can ask for it. The "continuance" part of it is like any other continuance. Say you show up and the asst. d.a. tells you that you need a certain form or document, you can ask for continuance and they'll reschedule the court date.

what they do with a PJC is essentially put the charge on the back burner (it's a long continuance of your case) for 3 years. If you get a ticket again in the three years, the charge you used the PJC for comes back and you're guilty of it. If you go the three years without getting a ticket, then it goes away.

So if you use a PJC, if you're not given a ticket for the next three years it's as if it didn't happen. If you get another ticket, you're guilty of the failure to stop and you get the points on your license. Along with whatever comes from the second violation.



edit: if you really don't mind paying the $300 for a lawyer, just get a lawyer. I've seen some simply make things go away in the past. there's no guarantee. But you never know.

i got a similar ticket a few years ago and was good friends with the DA in greenville. She called the Raleigh DA, and this is one of the few citations that coudln't be reduced. I had to use my prayer for judgement and it eventually disappeared. They could not do magic to make this disappear, however, she did make a 20+ over ticket disappear

The person who got the ticket actually got the same ticket a couple of years ago... we got a lawyer that time. Could we use a PJC this time? And would we have to show up at the court date to request this?

I will most likely get a lawyer if it means I won't have to travel back to that city to attend the court date and if it means the lawyer could possibly get it reduced.

The ticket was issued in Randolph County.

I got a right turn on read where such a turn was prohibiited by a legally posted sign. I think its 2 points.

I talked to the DA, he gave me 9 over speeding violation.
