I'll put it in a list so its easier
1. pulled over for improper vechile equipment in Brunswick county, got a ticket 2. went to court, pled guilty (non moving violation) 3. Paid Clerk of courts via cashier's check through bank/mail
Here's where it gets tricky
4. Got a letter in the mail saying my licence was suspended 5. Called DMV to inquire why, they say I was in violation "failure to comply" b/c i didn't pay the ticket 6. Call Brunswick county DMV, Fax them proof that the check had been certified, so they had to have recieved it and cashed it 7. Brunswick county calls DMV gets things sorted out, licence is good to go
So here is my question, technically I was driving with a suspended licence, I was in violation of the law. If I were to get pulled over with a suspended licence and got a ticket, and went to court before I proved that my licence should have never been suspended could I get that charge removed from my record/get back court costs?

You would just go to court and continue the case until you had the proof you needed. You would have never been charged/paid court costs to begin with. At least, that is the correct way for the whole thing to go down.

But whatever you do, if you are at the courthouse for driving with a suspended license, after getting your extension, don't let them see you drive away. 9/18/2010 2:48:27 PM |

You should be able to call the clerk and ask for a continuance

I think you'd be entitled to get the ticket dropped and everything back because state was negligent but the charge will still be on your record as dropped, unfortunately.
