Quote : | "A Triangle-area social justice group is planning to demonstrate at the Cameron Village shopping center this weekend after its co-director and partner were booted from the premises after showing signs of "gentle affection." SONG leader Caitlin Breedlove says she and her partner had just finished eating at The Flying Biscuit on Thursday afternoon when they went to sit outside. There, they shared a brief kiss after which a security guard approached them and said they had to leave.
According to a release, the security guard said that "being affectionate" was "inappropriate." The couple asked the guard if he would have said the same thing if they had been an opposite sex couple. The guard said, "No." The couple asked to see the security guard's supervisor, who also said they needed to leave, reminded them Cameron Village was private property and said, "You want this to be public, you want people to see what you are." |

There's video from WRAL on the linked page, but I couldn't get it to embed on TWW.
The Flying Biscuit, in their defense, has denounced the security guard's actions. That being said, I won't spend another dime at Cameron Village until I see a public apology and disciplinary action against the security guard. Or they can just cater to an increasingly bigoted demographic. My suggestion? Whites only. It wouldn't be a big change anyway, really.]10/15/2010 1:09:18 PM |

and that's relevant in what way? If it was a man and a woman 'full on making out' do you think the security guard would have asked them to leave? Were they being obscene? I highly doubt it.
Oh wait, this is TWW. The appropriate response to this is:

I think you just trumped your own point... At the end of the day it's private property and if that's already their targeted demographic, according to your statement, then they probably aren't going to be missing your dimes or the dimes of that couple. 10/15/2010 1:27:26 PM |

This has nothing to do with gays. In 2001, a security guard told me we had to leave when my gf and I were trying to fuck in the back seat of my car in a CV parking deck (near McD's). High schoolers can be dumb.

Everyone keeps saying this. No you can't. You can't discriminate against protected classes.
Of course, I don't think sexual orientation is a protected class in NC. So maybe you can kick someone out for being gay. But I know you can't kick someone out for being black.10/15/2010 3:01:34 PM |

Seems like a case of sensationalism to me...
Some people like to escalate a situation when there is no cause for doing so.
I bet it was more along the lines of "hey ladies that's not appropriate - let's take it somewhere else"
It looks like their response was the equivalent of "it's because I'm black, right?" No reason to put a securtiy guard on the defensive with an inflamitory accusation right away. Probably could have been handled better on both sides, but it never helps the situation to agitate an authority figure.
The statement of the "supervisor" seems to confirm this when he says "You want this to be public, you want people to see what you are."
Seems they were attempting to make a scene at this point. I don't know if you can say "making out" is obscene or not, but it's not really appropriate given the surroundings.
what if we all just tried having a little social couth... 10/15/2010 3:09:25 PM |

an unConstitutional provision in a law does not "back you up." Bastardization of the Commerce Clause does not give Congress the ability to usurp private property rights.

Well, there you go then.
I said (rather clearly, I thought) that they could exclude people, not that they should -- or should even be able to.
For the most part I think such laws are outdated. They're no longer necessary and lead to frivolous litigation. But rest assured I am aware that there are areas (my own home town, as a matter of fact) that require these laws or else nobody but white republicans would live there.10/16/2010 3:58:16 AM |

can we get some video uploaded of the couple's "brief kiss" or "gentle affection?"
that would solve this debate.
if indeed it was gentle affection or a brief kiss then the guard was in the wrong.
I feel like it may have been a little more than that but on the other hand I do know that there are some crazy security guards out there.

So it sounds like they didn't intend to have double standards, and that it was the actions of a rogue mall cop.
The private property /thread argument doesn't work so well when the private property owners didn't want the rent-a-cop's behavior to be happening rather than the kiss.10/16/2010 11:55:10 PM |

This is a PR issue, not a legal issue.
It sounds like the actions of a rogue guard/supervisor. I'm amazed people would argue that the Civil Rights Act is not the law (who knows if the supreme court ever throws out decades of precedent, but it is clearly the law now), but it does not extend to sexual orientation in NC. 10/17/2010 3:40:42 AM |

If sexual orientation was a protected class under the Civil rights act of 1964 (which it isnt), then it doesn't matter if your restaurant is on "private property".
This argument was settled about 45 years ago in cases like Katzenbach v. McClung, 379 U.S. 294(1964).
If the operation of your restaurant effects interstate commerce, (and the court has pretty much determined that EVERYTHING effects interstate commerce, so its just about impossible to wiggle out of if you are operating some kind of money making business), then congress has the right under article 1 sec 8 clause 3 of the constitution ("the commerce clause") to ban discrimination at the place of business on the basis of race, religion, or national origin. 10/17/2010 12:06:54 PM |
