yes, it is legit...

i could see a 15-30 hit right off the top if i had even broken the plastic seal, but this is brand new, the only difference being that it isn't on a store shelf or a warehouse in TX.

Usually when you buy something it does not retain 100% of it's value even if it's unopened. You're not going to make all your money back on this. Why are you selling it in the first place?

i'm selling it because i bought two on a good deal, and figured i could make a few bucks and somebody else could save the trouble of tax / shipping / driving to a store / keeping up with a gift card / etc

"!=" means "does not equal". retail is $299 + tax. without any special deals, the total is just over $322 if you walk into a store and buy it.
