So I went out last night to White Collar Crime and ended up picking up a random chick on the dance floor that wanted to go back to my place with me. I happily oblige as she is a very attractive. I suggest a cab as this was my original plan to get home but she decides she wants to drive her car. We end up making it back to my apartment complex safe and park near one of the buildings. I inform her that she will be towed unless she parks in a visitor spot and in her inebriated state she decides to "stick it to the man" and parks in the grass between two buildings sevearal hundred feet away from the pavement. I promptly get her out of the car and I remove the car from the lawn and park it several buildings down as the only available visitor spots are there.

After that I walk back and hand the keys back to the girl before we go into my bedroom. We end up not doing anything so I grow bored quickly and decide to pass out. The girl tries to convince me several times to walk her out to her car but I refuse as I felt no obligation (It's not like I got anything). I tell her where her car is and fall asleep promptly as soon as she is gone.

Several hours later at 6 AM I am awakened by a Raleigh Police Officer shining a light in my eyes in my room (Roommate let him in after he was pounding on the door). He doesn't waste any time and starts interrogating me immediately. He claims I drove the vehicle into the grass (tire marks clearly present) and used a vehicle without "authorized use." I of course deny both charges without telling the officer it was the girl as I wasn't sure what was going on and didn't want to get anyone in trouble. The officer then starts badgering me about where the keys to the vehicle were and the actual car. I quickly find the keys on the coffee table in the middle of the apartment and then lead him towards the extra visitor parking spots. Along the way he makes snide comments about taking a "nature walk" to have to find the vehicle, which is backed in neatly in the first visitor spot.

While walking outside I notice the girl is with the officer and can't figure out who the hell called the police. My best guess is a neighbor but as I think about it I am more and more I am sure it had to be the girl trying to find her car.

Anyway, after telling the officer multiple times I had nothing to do with the vehicle being parked on the grass, he decideds that it is indeed my fault (even if I didn't drive the vehicle) as I had invited a guest back to the apartment complex. He tells me he is going to charge me with a felony "unauthorized use" unless I contact the apartment complex first thing this morning and let them know it was my fault as my guest had caused the damage. Evidently it is a crime to move a car off the grass and into a visitor parking spot.

In short, I am very pissed about this whole thing and am about to file a complaint against the officer for threatening me with charges that have no grounds. I'm not sure if it the best idea. Advice??

Note: I never had a chance to say anything to the girl, but after being awake for a few minutes I think she was actually the one who called the police in her drunken state, trying to find her vehicle. Hilariously she ends up in the back of the patrol car before the officer leaves. I still have no clue who called the police and led them to our apartment or if the girl ended up being charged with anything. I am assuming she recieved a DWI but I will never know as I can't remember her name and I told her I didn't want her number as she was leaving the first time as I felt she was a huge cock tease. Maybe I'll see it in the police blotter later.

So you admit that a guest of yours caused property damage to your apartment complex.

Pretty sure your liable for said damage.

And if you drove her car without her consent then yes, that is unauthorized use.

AND you admit you let her drive intoxicated.

What are you complaining about again? A cop doing his job?

roommates and house guests always seem to be so dumb about cops. NEVER tell the police anything, you have nothing to gain. ONLY say "can I help you, officer"? then repeat that phrase until they figure out you know your rights. And show them I'd, or else they can haul you downtown to "verify" your identification. Once some clown lets them in your house, all they can do is look around for what is in "plain view", they can't mess with anything. So when the cop saw the keys, you just repeat "can I help you officer".
The cops ONLY job is to find a reason to charge people with crimes: they're not there to resolve, or arbitrate, or be cool, or help. Everything you do beyond above just makes it more difficult for a lawyer to defend you. It is not your fault the law is the way it is: it is not your fault you have to be so "rude" to the cops but you have a DUTY to exercise your rights or else we LOSE our rights.
The officer wasn't there to help the girl, or to protect the apartment bldg, or anything else: his job was to look for reasons to charge people with crimes, and that's exactly what he did, you have no grounds for complaint. Actually, the law being structured the way it is, you actually WANT cops to behave this way or else unrelated legitimate criminal cases could collapse under fire from powerful unscrupulous defense attorneys. There is a video published by the ACLU about how to properly deal with cops, check it out sometime.
Keep in mind too there are differences from state to state, for example there is actually a "damned if you do, damned if you don't" loophole down here in Florida making it very easy for cops to charge you with "being uncooperative", lol. But at least we're not crawling with cops down here like you are up there in NC, it's part of the reason I moved away.

I'm complaining that I had nothing to do with said damage (two tire marks in the grass) but I am liable when they have the culprit in custody. I am also pissed because the officer is threatening me with a FELONY of which I had no part.

I did have her permission to move the car.

You need to understand: everything the cop says is meant to manipulate you into revealing information to assist the officer in making charges stick to anyone and everyone. Once the initial police involvement is over, it is unlikely the officer will be charging anyone with anything. You also need to understand the difference between Criminal and Civil court. The property damage is the responsibility to the property owner to pursue through civil court, which they won't do over some grass.

I am ranting b/c the way the officer assumed I was the guilty party from the start and then started threatening me with charges that had zero basis. Even when I had a roommate and his gf verify my side of the story, he was still threatening me. He went through the whole excercise at the end of "Do you know what a felony means, son," and then "i'll be checking up on you and if i don't like it then i will charge you."

BTW the charges are not a felony, he was just trying to act like an asshole.

You should be pissed the roommate let the officer in, I would be livid at the roommate. What if the chick had some file or weed on her and left it in plane sight it something? Nothing good comes from letting the officer in or talking to him.

yeah, if you would have shown the girl to her car, since you did move it, you probably would have avoided this problem. That was a dick move on your part, and karma came around with a cop who called you on being a dumbass.

The first thing you need to do is have a talk with your roommate about never letting the police inside your residence. For no reason should they ever be let in, unless they have a warrant. If there had been weed on the table, and you didn't admit it was yours, you both would be getting in trouble for it. If you explain that scenario to your roommate, he'll think twice about letting the police in again.

Also, never tell the police shit. If the cop had enough evidence from the girl to charge you with a crime then he would have done so. You shouldn't have said anything, but if you felt that you absolutely had to then you should have said that you had no idea how those tire marks got there and that the girl had been intoxicated and must have forgot where she parked. You should have then asked the cop if you were under arrest, and unless he said yes, went back inside and closed the door.

You were also absolutely correct in making that bitch walk back to her car herself. I'm sure there will be some people who reply to this thread that such treatment is mean, but you had no obligation to her. Do you think she would have walked you to your car if you had gone to her apartment and refused to give her a deep dicking?

the officer that arrested me for my biggest mistake ever bashed my head into the door sill on his cruiser because it seemed like a fun thing to do.

Advice: Drop it and be smarter next time.
Have an agreement with your housemates not to let the cops in.
He should have told the officer that he would check to see if you were there, shut the door, and come to get you to handle the situation.
Stop talking to the police. You didn't have to say anything. I personally would have made the statement that I did not drive the car home and did not drive it onto the grass. Any other questions should be answered with "I don't care to comment on that at this time."

The cops aren't going to charge you with any property damage. You said yourself that you had permission to move her car, so you shouldn't have to worry about unauthorized use.

Face it, that cop wanted to make you squirm and you fell for it hook, line, and sinker. You let him do that to you whether you realize it or not.

One of the local Highway Patrol officers did that to a friend of mine. I can't remember the guy's name now, but he was one of the ones who got in a bunch of trouble a few years back.

Yeah to give you an idea of how guilty until proven innocent you are... The cop's description of what i was wearing didn't even match the effing mug shot (attached to the file) which in my book would discredit everything he had to say but it didn't.

$5 lafta bucks says that the cop was either the girl's brother or dick in a glass jar friend that she called to fuck with you. He probably gave her a ride to her house after he got you all stirred up. He's not going to press any charges, so don't say anything to the apartment complex. If you had the girl's license plate number, I would give that and a description of the vehicle to the apartment complex so that they could file charges for destruction of property.

Cops say dumb shit all of the time in an effort to bluff you into saying something stupid back to them. The correct way to handle their threats is to just look at them and not say anything. You should say something to your roommate about to never just let a cop into the house without a warrant.
