She also declared that cops are all lazy, claiming that they sound their sirens to bypass traffic jams. Garaufis flipped forward several pages in her questionnaire. He landed on the page where she had said she had a relative who was a member of the Chinese Ghost Shadows gang in the 1980s, convicted of murder and still in prison. "Why didn't you put 'Asians' down also?" the judge asked sarcastically, referring to her list of least-liked people. "Maybe I should have," she said. Assistant U.S. Attorney Taryn Merkl requested that the woman be disqualified from the Vinny Gorgeous case because of her "inappropriate" comments. The motion was granted. It is not unheard of for people to try to get out of jury service by making ridiculous statements concerning their views. It was unclear Tuesday whether that was this woman's motive. And if it was, it didn't work. Indeed, the woman was going to be seeing a lot of Brooklyn Federal Court. "She's coming back [today], Thursday and Friday - and until the future, when I am ready to dismiss her," Garaufis said. One thousand prospective jurors have filled out questionnaires for the Basciano case, approaching the Eastern District of New York record of 1,089 summoned for the late Gambino boss John Gotti's trial 20 years ago. Nearly half of the jurors are struck before they even get to court for questioning due to language barriers, fear of the Mafia or their extreme views for and against the death penalty. The panel members that do get selected for the trial will be anonymous and transported to the courthouse by U.S. marshals to thwart any possibility of jury tampering."

that judge is a dumb fuck who, contrary to his own belief, does not have the right or power to ASSIGN jury duty, ESPECIALLY if the person admits to being racist

i've had two lawyer acquaintances hint (obviously they can't and shouldn't say it outright) that if you want to get out of jury duty, you should demonstrate racist viewpoints for the obvious reason that you'd be seen as incapable of impartiality

if i were the woman, i'd sue the judge for being a dick

So how does "jury duty for life" work? In NC at least there are a few rules that would prevent this. Just off memory:

1) You can be excused from jury duty for one year if you came in for jury duty but you were not sequestered for a trial.

2) You can be excused from jury duty jury duty for two years if you were sequestered for a trial.

So in NC she'd come in that day, they wouldn't use her, then she'd be off the hook for a year.

Well this is 100% true. I don't have enough fingers and toes to count the times I saw cops do this during my 3 years living in NYC. However I'll also say the 2 times I needed the cops they arrived fairly quickly.

I had jury service a couple of weeks ago and even though I knew one of the witnesses in the case they still didn't cut me loose. However, the lady who stated she couldn't serve because she couldn't sit still was dismissed.

The judge is not punishing the woman because she is racist- he is doing it because she was trying to get out of jury duty. He has no legal right to punish her for her beliefs. But to try and work the legal system? yes...

Can't get pulled over for not wearing a seatbeat, but you can get a ticket for it if you're pulled over for speeding.

Similarly,

You can't get charged for being racist, but you can get charged with racism if you're caught committing any other primary offense.
