A lawyer could easily argue that he retreated and they followed him. The first hits were probably justified and he would have walked away with no charges had he stopped then. Everything after 0:44 is probably the reason he is being charged.

It kind of sucks if he legitimately was trying to stay out of trouble and some other scum instigates an incident that puts him back in jail. The law says you have to use restraint even if you aren't the aggressor. I can't say I feel any huge moral objection although I do think he went a little overboard.

One of the youtube videos of the news says that the argument started when the women tried to pay with a 50 dollar bill and he wouldn't accept it.

I do think that he went a little too far. They shouldn't have jumped the counter though.

I will say this though. I have been attacked by two punk kids when I lived in Indiana. They pulled up past me in a car while I was walking one summer evening. I was about 16 and thought they knew me. Long story short, I got beat up pretty bad and had a gash on my head and a broken jaw. They panicked and drove off. I swore after having my mouth wired shut for 2 months that if something of this nature happened again, the police better get to them before I seriously hurt the bastards.
