The First Amendment (Amendment I) to the United States Constitution. The amendment prohibits the making of any law interfering with the right to peaceably assemble.

I don't understand what's so hard to understand about the first amendment. I am in shock.

I'm going to write a letter to the US Government to cover my losses from the last quarter of my life. It's only about 10k, I'm sure they can handle it.

^ So it should be straight as long as they go sleep in the comfy beds in their heated homes every night and come back in the morning, right?

I mean, that's pretty much easier for everyone.

That seems to be the main argument.

The Bill of Rights says
Quote :
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Of course, it's not complete without common sense which was applied here:

Quote :
"Originally, the First Amendment applied only to laws enacted by the Congress. However, starting with Gitlow v. New York, 268 U.S. 652 (1925), the Supreme Court has held that the Due Process Clause of the Fourteenth Amendment applies the First Amendment to each state, including any local government."

the.

people.
peaceably.
to.
assemble.

It's clear that restricting location is an unquestionable violation.

It's bullshit.

Mount Trashmore is actually pretty awesome. I'd definitely check it out if they get a permit for there.

please elaborate. it looks to me like you copied/pasted from wikipedia and omitted parts of the amendment not relevant to your claim

and i think the key word in your overly punctuated post above is peaceably ... judging by the problems that other U.S. cities are having with "Occupy" protestors, I feel like it isn't entirely unreasonable to deny the permit

Occupy Wall Street Now Occupying Courtrooms With First Amendment Lawsuits

Now that Occupy Wall Street has grown from a handful of demonstrators taking over a Lower Manhattan park to spawn offshoots in cities around the U.S., the movement is now occupying courtrooms.

The young movement has lawyered up and filed lawsuits asserting freedom of speech and assembly in federal courts in Cincinnati, Sacramento, Nashville, Dallas and Atlanta, to name a few places.

They didn't say they couldn't go there and protest. It just said they couldn't go there and setup a fucking campground on public property.

People are getting tired of this shit.

constitutional rights come before your "getting tired of this shit"

The whole purpose of protesting PEACEFULLY is for you to "get tired of this shit" and make a change.

WE'RE SICK AND TIRED OF OUR CONSTITUTIONAL RIGHTS BEING TRAMPLED.

And I'm sick and tired of not being able to go into a park without some unwashed hippies with signs about hemp and some unintelligible shit scrawled on pieces of cardboard plopping up 50 ratty-ass old tents all about and strewing the place with garbage.

My tax money goes to these places so I can enjoy them, not so some small subset of the population can basically set up a squatters tenement there.

You want to go there and protest? Fine, have at it. But it ain't a fucking campground.

^ I think you need to deal with the fact that it isn't a Motel 6 out there.

Your tax money is already $14Billion in the hole. That we PRIOR to any protests. So don't use that as an excuse.

You don't have a constitutional right to walk in a park "without some unwashed hippies with signs about hemp and some unintelligible shit scrawled on pieces of cardboard plopping up 50 ratty-ass old tents all about and strewing the place with garbage."

Do you see how the protesters will always win. We have the constitution on our side.

^^ Go take a look at the front lawn of the old courthouse in Charlotte, unless they've drastically cleaned it up.

^ Do you have reading comprehension problems? The point is they can't take it over completely and use it as a campground. They can stay there all they want, WITHOUT the tents. You wanna camp? GO TO A CAMPGROUND.

public assembly is subject to time/place/manner restrictions.

Supreme Ct. has said as such, on multiple occasions.

sorry, but you're mistaken. ^^

Government entities may make reasonable content-neutral restrictions on the time, place, and manner of a speech or assemblage, even in a traditional public forum.

This action directly affects the rights of assembly, since a government entity may restrict the time and place where an assembly may take place, as well as the manner in which the assembly occurs. The restrictions must be reasonable and narrowly tailored to meet a significant government purpose. The government entity must also leave open ample channels for communication that interested parties wish to communicate.

Freedom speech means freedom of speech. EXCEPT you can't say BOMB in an airport. EXCEPT you can't say FIRE in a movie theater.

Once you put exceptions in there, it ISN'T FREE SPEECH ANYMORE.

Do you see how we have been wronged by the government?!?

I'm doing my part in the cause by raising awareness to my fellow slighted Americans of TWW.

There are 300,000,000+ people in this country.

It only takes a few in the government to change a policy for 300,000,000.

It takes 300,000,000 to change a policy in the government.

how many of those 300,000,000 are in government

cuz that makes it sound like a lot less people can change a policy in the goverment

if just a few in the government can change a policy

I'd be absolutely furious if I was still a citizen of NYC, what with these lazy bastards wasting millions of the city's money and negatively affecting tourism and local businesses. It's also beyond me how trying to construct a shanty town can be the least bit legal.

I agree with the core message, but it's being given a negative spin by all the loonies. Nevermind they're protesting in the wrong location. Go to DC and make yourselves useful.

This. I got your point at first, geniusxboy, but your arguments since then just lack common sense (I guess this is Chit Chat). Saying that the government is limiting our freedoms because we can't shout "BOMB" at an airport is a pretty amazing claim. I guess you are a big advocate for some kind of bastardized anarchy where we have a constitution, but no government to provide for the public good.

Yeah... a question I constantly hear from people who advocate for anarchy because the ultimate answer is "we are only free so far as it does not interfere with others' freedom... a boundary that is defined by a representative government of the people." That means that in reality, no... YOU are not really free to do whatever the Hell you want.

But of course you know this already. From your earlier post: "Civics 101."

The constitution is pretty specific of defining these freedoms that shall NOT be infringed in any way, shape, or form. Everything else is fair game.
