According to court documents, Victoria Alexis Jones was in her Dorthea Dr. residence around 8 p.m. on January 13 with her two small children when 40-year-old Lucio Miranda allegedly broke in.

Jones said she asked Miranda to leave and when he didn't, she said she sprang into action.

As Miranda closed in on her, she grabbed a wooden bed post.

"He's still coming towards me," she recounted. "And the only thing I knew to do was to protect and defend my family. It just so happened I have an old bed with a solid wood oak post, and it was loose.

She said she grabbed the post and started to beat Miranda.

"As he got in the living room he was about to run," Jones said. "When I hit him that last time, I hit him in his head and he fell out."

Miranda was still on scene when police arrived to arrest him. A booking photo showed him with his right eye swollen shut from the beating.

Miranda was charged with first-degree burglary and possession of stolen goods.

He was treated at WakeMed for a head injury and a broken ankle."

What that article doesn't say that the video has is that once he was down from the head hit, she started hitting him in the feet and ankles so that he couldn't leave before the cops got there. Now he has a broken ankle.

Also, when the guy got into the house, the woman was in the back about to get in the shower while the kids were in the front. He told them to keep quiet while he went back to get to the mom.

So, isn't her pursuit of the guy illegal or something? Is that just limited to shooting intruders, or did that change with the new laws

That's my understanding. You can use an appropriate amount of force to stop an attack, but once the attack is stopped it becomes assault if you keep pummeling them.

I doubt they'll bring charges against her, but he probably has a good lawsuit if he decides to pursue it.

Nope, not if she's got a legitimate fear for her safety. And I would, if I thought he might wake up before the cops got there. How many times in those horror movies do the victims let the murderer go because they think he's dead, only to get stabbed later. He's still in her house, she can neutralize the threat all she wants.

On a more serious note...
Good luck proving he was still a threat when you knocked him out as he was running away from you.

And extra good luck proving he was still a threat when you opened your stupid mouth on the news and told the world you assaulted him for the purpose of detaining him until the police arrived. You can't really take that back and say "lol, jk; I was really scared of him."

You don't have to cite those horror stories, the jury has that in their head. All you have to do is convince people that you were genuinely afraid. Get a bunch of people on that panel who are afraid of home break ins, robberies, and put a big scary guy in the attacker's seat, and it's a slam dunk.

^^ I agree and I wouldn't want her to be charged. Still, people need to think about their actions in situations like this and they need to be especially mindful of their words after the incident.

She had all the right in the world to shoot him when he came into her house, but you can't legally assault someone once they are no longer a threat. If she really wanted to ensure the safety of her family she would have taken her kids to a safer location when she knocked him out.

She gave him a well-deserved ass whooping, but that doesn't make it legal.

I feel for you if you're willing to let your freedom rest on the notion that you can convince a jury not to convict you despite overwhelming evidence to the contrary.

You're still treating the intruder as a threat long after the actual threat was resolved.
The threat was legally resolved when he tried to run from her and she knocked him out. Breaking his leg just to keep him around until the police get there could very easily be considered assault or illegal detainment.

It's no different in principal than the convenience store owner who was sent to prison last year for killing an armed robber. The courts ruled that when he shot the robber the first time it was justified as self defense. The second time he shot him the actual threat had already been eliminated and it was therefore murder. I'm sure someone can dig up the TWW thread about it.

There are a lot of reasons that a D.A. might choose not to pursue legal action against her, but "not being charged" is not the same as having a ruling in your favor.
