...for Apex Town Council if you had known of his arrest and upcoming trial for DUI?

http://www.newsobserver.com/2012/02/04/1829082/council-member-fights-dwi.html

Related, I'll be interested to see if this defense actually works.

Quote :
"
RALEIGH -- An Apex Town Council member convicted in January of driving while impaired is appealing the verdict with an unusual defense: An acid reflux problem, he claims, skewed the breath test he took when arrested.
....
The crux of the argument is this: GERD can cause the regurgitation of undigested or semi-digested acids containing alcohol from the stomach back into the mouth or throat.

I didn't vote for him because he's 24.

But a DUI? No, that wouldn't have stopped me. Innocent until proven guilty, and even then, people make mistakes.

^^^I ask the question because I'm genuinely interested.

A local citizen who put himself in the public eye and wins an election is now being questioned by people in his elected district b/c they don't feel like he was honest by disclosing the arrest.

On top of that, he is employing a little used and risky defense and some pretty bold court room strategies.

I'm not judging him at all, just trying to open up discussion. If I have an opinion at all right now, it's that this guy has huge balls.

better to give it a try than fold up and quit.

thats why we have the court system.

I dont blame him...I'd try it too, especially if its indeed true.

Scott is a good guy, I could see him actually having this happen.
and no reason to disclose it if you think it was wrongly placed upon you.

if he is guilty, resign. that simple.

If he really thought he wasn't drunk at the time of arrest, why didn't he demand a blood test be done?

you have an intimate enough knowledge of his acid reflux to suspect it would cause a false dui?

I dont know that he has this, however, I know him and his family well. I suspect that he would not try and use some random thing to get out of it. I mean all you need is a doctor to disprove it.

and yes, why not resign if he is guilty?

I'm not saying you are right or wrong on whether he should resign if guilty (technically, he already is - he is now appealing). I was really surprised to hear you say that...just wondering why you feel that way.

Do citizens who perform Public Service disqualify themselves from doing good work after they use bad judgement in their personal lives? Could he not redeem himself by doing great works of public service instead of resigning?

Plenty of jobs will disqualify you for DUI, or terminate you if you get one after you have already been hired. The public service aspect really has nothing to do with it imo.

Unless he somehow develops a method to end world hunger in his tiny suburban laboratory, no one can do a great work of public service working in fucking Apex.

And I don't know a whole lot about Town Concil, but if he drives a government owned vehicle or is ever required to drive for work, then he is pretty much screwed.

Acid reflux is not that unusual of a defense. If you have any history of that problem, a good attorney will latch onto it, spend a lot of money on experts, and more than likely get you off.
