Holy shit. I feel so bad for this guy. If you were good enough to be offered a ship by USC, then you probably had a decent shot at playing football in the NFL along with the money and benefits that come with that lifestyle. All that was taken away from him.
I wonder what he plans to do with his life now. 5/24/2012 4:47:50 PM

^^ I mean, he pleaded no contest at the advice of his lawyer. Still, your point still stands... what kind of fucked up justice system do we have where an innocent person might think "it would be better to admit guilt, because I'll probably get a lesser punishment than if I deny guilt...cause they're going to find me guilty anyway."

I hate to say this, but the pendulum has swung so far in the direction of protecting the victim that a man pretty much has to prove his innocence if he is accused of rape. You can't bring up sexual history, questioning the accuser/victim's behavior on the night of event, etc. is pretty much disallowed. Unless you can prove that she completely fabricated the story you're up shit creek. 5/24/2012 5:54:59 PM

It's kinda crappy. You want to encourage people to come forward with the truth, and prison isn't much of an incentive. So...?
I mean, she coulda just kept quiet...invented some story in her head about how he was a dick and he kinda/sorta raped her in a way, and her family really needed that money...and just drown the regrets in booze whenever they happen to peek through. 5/24/2012 6:16:38 PM

I'm just saying...if you want more fake "victims" to recant, then threatening them with prison time may not be the best way to go about that.
In fact, people might go forward with false accusations precisely because they're scared of the consequences of being discovered as a liar.
But it's such a touchy subject that it's kinda hard to be like, "Hey, before you continue, are you sure you might not be mistaken or confused about your recollection?" 5/24/2012 6:26:51 PM

I don't think false accusers are likely to come forward most of the time anyway. There are real, legal consequences for perjury, and I assume that this woman will have to deal with those.
Quote : | "But it's such a touchy subject that it's kinda hard to be like, "Hey, before you continue, are you sure you might not be mistaken or confused about your recollection?"" |
We call that a lawful oath, i.e. "Do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?"

Let's apply this logic to serial killers/rapists who got away with their crimes...
If you want more serial killers to confess to their murders, then threatening them with prison time may not be the best way to go about that.
But it's such a touchy subject that it's kind hard to ask a suspect like, "Hey, are you sure you didn't murder or rape all those children?"
Also, if these criminals came into huge sums of money through their crimes (i.e. insurance fraud), let's make sure we don't take away that money or we might discourage even more confessions.

BridgetSPK has always espoused these such opinions on here.
I hate rapists to the core, but I hate fake rape victims who accuse someone by name of raping them even more.
Rapists destroy a woman's life, and the whole world sides with her and sympathizes with her.
Fake rape victims destroy their accusee's life (and career, and family), and the whole world sides against him and hates him. (and he COULD GO TO JAIL for something HE DIDN'T DO, and suffer in jail)
It is easy to see which is worse, from a consequences point of view.
And so it is easy to see which should get a more severe punishment. Heck, if fake rape victims get even half the punishment of rapists, it would still be a great thing.

^^^,^^^^AHA, relax, guys. I was just tryna bring something different to the table.
I know that a huge portion of rape allegations are fabricated, and the police work hard to get down to the bottom of stuff. But then the police are criticized for not closing enough rape cases.
It's a weird situation in the justice system. 5/24/2012 7:25:05 PM

tough case to prove?
Quote : | "Banks' first move: To get everything she said on tape. He hired a private investigator and met Gibson in the man's office, where every conversation was secretly videotaped. The tape recorded Gibson saying, clearly, "No, he did not rape me."
Was he nervous she wouldn't say it?
"I didn't have to get her to say anything," Banks said. "She came into the room expressing herself. She even came back the next day. The investigator asked her again, point blank. 'Did Brian rape you?' 'No.' 'Did he kidnap you?' 'No.'"" |

And why would Gibson meet with Banks in the first place? Was it a trap? Was it guilt? No. Banks thinks Gibson -- are you ready for this? -- was hoping to get back together.
"You read the texts and that's the only conclusion you come to," says a source who worked on the case. "She seems absolutely clue-free about what she did to him."" |
