So, if a cop pulls you over, and says that the reason they pulled you over was for speeding, when you know for a fact that you weren't speeding, is it an illegal stop?
And I'm saying you know that you were not speeding because you had set your cruise control for the speed limit or under. Or you just know that you weren't...
Also, not saying that this has happened to me, I've just heard stories about it and I was wondering that tonight.

Another question...
Why do people insist on going to The Sanitary? It is not very good. It's over priced and an under quality of food. I don't understand why people swear by The Sanitary.

Also,
So the break light and the battery light come on in my car, however, it's kinda sporadic..and they dim and flicker. Is it a short in my dashboard...or is there something wrong with the battery in my car?

And one last question...wtf is up with the Raleigh Beach? That is dumb as hell!

"So get this. Saturday night...or really Sunday morning...around 1:30 am...I'm driving home from my friends house. Sober. I am in a 35 mph speed limit zone. So that I don't give a cop a reason to pull me over I set my cruise control.
I am driving down the road and see a cop going in the other direction...and just like habit I check my speedometer. I am going around 35 or 36. As soon as I look up from my speedometer and check my rear view mirror there are blue lights behind me...

I pull over the cop says. "Do you know how fast you were going?"
Me: "35"
Her: "I clocked you at 45"
Me: "Do what? I had my cruise control on 35?"
Her: "Oh...can I see your license please?"

She then calls it in, doesn't go back to her car or anything...just calls it in right beside me and then sends me on my way.

She just though she was going to get a drunk driver...didn't she?"

Please guys! These are serious questions!

^Ok...so it has happened to me...but not very recently...I was thinking about it tonight though cause the subject came up in conversation! It actually did happen to a friend of mine this week. Same town and around the same location in the town. That's why it came up tonight.
You sure are the detective! You're awesome!

To answer your speeding question, it's a legal stop. Even if he didn't use radar, he could say that by his visual determination he estimated you traveling over the speed limit. Would that hold up in court? No. But it constitutes a legal stop.

Cops can always find a reason to stop you. The issue comes when they try to detain you or when they actually charge you with something that they found after the stop, and unrelated to the reason they stopped you. Only then can the "Legal Stop" aspect come into play, and your lawyer would definitely bring it into play.

If you didn't get charged with anything, what does it matter? Legally speaking, it's no different than a Driver's License Checkpoint.

Everybody I know in Morehead and the surrounding environs hates Sanitary and says that only tourists go there.

The only thing I know about Sanitary is that all the rich kids wore their t-shirts.

Even if it was an unjust stop, you would have to both prove it, and establish a pattern for it to amount to anything. Unless you and ten other people.file a.complaint that she stopped you, or some department has a rampant history of this, good luck.

they could make up some bs where they said they visually estimated and elected to not write a ticket. You couldn't prove it wasn't the case. Establishing profiling on the other hand....

^^^^ a drivers license check point you don't need probable cause to check, because youre doing it to everyone.

Its wholly different.

Sanitary. Few years back I went to the beach with a group of friends and the general population of said group decided to go there for a meal, I lead a coup of 2 or 3 others with real appreciation for seafood and went to another little place closeby...had an awesome time/meal, got drunk, forgot the name of the place

The Sanitary is like going to Hymans when in Charleston. I would throw Dockside into that as well...except Dockside is actually decent.

I'd have to rate Sanitary higher than Libby Hill. I'd lump Libby Hill in with Captain D's and Long John Silver's

Although I think Libby Hill has an oyster bar now, which is kind of scary.

See this is the shit that ruins "it was a friend" stories. This wasn't even a bad thing or a thing to be ashamed of.
