So back in Dec I got a ticket near the airport for 20 over. (65 in a 45). I hired this lawyer to take care of it for me. After several continuances it got knocked down to a 54/45, which is good. However, it appears that the lawyer didn't pay the fine as promised, and now the DMV is going to indefinitely suspend my driver's license in Sept if it isn't cleared up. I've called and called and called this lawyer and they've still not corrected their fuck up.

What courses of action do I have at this point? I want to get this shit fixed quickly.

(btw, this is all in NC, here in good old Raleigh).

Did you pay him the money for the fine and did he put it in a separate trust, or did he just include all that in his fee? If it was all inclusive, do you have it in writing that your fine was included in the fee?

Any time I have ever needed a lawyer he has put my fines in a separate trust. If I end up not needing to pay the fine, he just deducts it from my total bill or reimburses me.

Pay the fine, now. Don't wait around for the lawyer to screw you more. The state doesn't care who is supposed to pay it. They just expect it paid. Pay it, save a copy of the payment, then make a trip to the lawyer and ask for a refund.

I've been disappointed with the whole damn thing. PM me if you want the name of the law firm, so you can avoid them.

So I can just call up the DMV, pay the fine for the reduced 54/45 and things will all be good with them?

Everything was included in his fee, and it does state on the paperwork that any fine/etc comes out of the fee.

In wake county getting it reduced is about the only thing you can hope for

you don't pay the DMV. you pay the court cashier's office.


i got 70 in a 55 in Person County. went to court and talked to ADA. reduced to improper equipment. paid the fine and the court cost at the cashier's office. few weeks later i get the same letter from the DMV saying i didn't pay my fine and they would suspend my license in a few weeks. went to the courthouse and the cashier sent me to the criminal division. lady there said that she showed it as paid and i must've "slipped through the cracks". they gave me a fucking letter and she signed/stamped it and said if i got pulled over and had trouble to show them that. what a fucking joke.

perhaps the same sort of thing happened with your case. apparently there are "cracks" for you to fall through.

i once had a court case that got fully resolved, and i, on a whim, checked the court calendar online a couple weeks later, and saw i had an upcoming court date for the same ticket later that month...called my lawyer and they were like "well i dont know what this is about"...called the clerk of court and they were like "oh, well this is odd, you must have gotten added back on accidentally"

buncha fuckin idiots making sure tickets get processed and schedules are updated properly

+1. You can usually do that shit on your own. Only way it's worth paying for that is if it's out of town.

OP, how did you hear about this lawyer?

The staff at the courthouse is extra special. Its a shame they do not get thrown in jail when they forget to mark a charge dismissed/paid/etc and a warrant is issued in error.

some lawyers will sue for anything they don't like

I was in another state's version of Cary blasting a trench down main street
this damn suit comes out and says he is going to sue us for cracking the
foundation of his building. We informed him we had not blasted yet.

he said "well i'll sue you for something before you get done"

yep, dude was a lawyer

If you walked into court they would have immediately offered you the 9 over, then you pay and walk out.

Only reason to get a lawyer is if you can't make your court date or it is serious driving violations.

Depends. I had a similar case. I thought I was going 13 over. I was actually doing 18. DA knocked it down to 9 over, Judge accepted my PJC.

All in wake county.

I had a ticket that was basically the equivalent of a reckless (driving in the wrong lane) and I asked for a PFJ, and the fucking judge says he only grants PJC requests when the requestor's license is in jeopardy. Asshole.

Went to the courthouse with all the paperwork from the lawyer, paid the ticket, got everything clear with the DMV. Then I went to the lawyer's office (which was nearby) and told them that I paid and showed them the receipt, and they refunded me all the money I'd paid them.

small victories.

I think that's fair that they refunded everything for their error, and not just the ticket cost. People make mistakes, its shitty that it could have cost you badly, but they made good.

yeah, I wasn't expecting it nor did I ask for anything from them. It ended well, however I most certainly won't be using them again.
