Legally, the person who initiated the drinking is the one doing the raping. Especially, if the person who didn't initiate the raping hasn't consented to sex prior to the initiation of drinking.

In the seminal case of In Re: Buttsex, (an amicus briefing on same topic see NC Supreme Court Reporter at 69) voluntary intoxication does not vitiate consent.

Recently courts have conservatively interpreted Buttsex, but it is still good law.

The law isn't always consistent.

The cliffs notes are:
You are never too drunk to be able to decide whether or not to drive.
However any other decision you make while intoxicated is null and void and the person who asked you to make that decision is considered predatory.

Which if you have to make blanket statements that could be upheld as law I think this is the best way they can do it however it does end up in some innocent people getting royally fucked.

If an animal rapes you, then aren't you legally raping the animal? Because in the eyes of the law, the animal can't be guilty... on the basis that it's an animal. So if inter-species sex happened, it would have to be the fault of the human.
