Ok I dont know if he was actually treading water, but when you read the term "high water" you assume it's deeper than the person.

And if he was having trouble in the water, even if armed, I don't see how he could effectively use a weapon.

Cops in GTA keep shooting when you're in the water. I think that's a fair legal precedent.
