"RALEIGH, N.C. — The second trial for Jason Young has been pushed back another week because of an unrelated scheduling issue, the prosecutor trying the case said Wednesday.

Young, who is charged with first-degree murder in the death of his pregnant wife, was scheduled to be retried Jan. 9.

Wake County Assistant District Attorney Becky Holt said the trial is now set for Jan. 17 and that she expects it will last about six weeks.

Young's first murder trial ended in a mistrial in June after a jury couldn't reach a unanimous verdict.

Jason Young was arrested in December 2009, more than three years after Michelle Young was found beaten to death inside the couple's Wake County home.

He has maintained that he was out of town when the crime occurred and that he had no involvement in it.

Defense attorneys argued that someone else, possibly two people, killed Michelle Young, noting DNA evidence found inside the house didn't match Jason Young and that there was no physical or circumstantial evidence implicating him.

This is the second time Young's retrial has been rescheduled. In September, a judge moved the date from September to Jan. 9 to allow the court reporter more time to finish transcribing the original proceedings.

Young is out of jail on a $900,000 secured bond."

Estimating a six week trial now. Sounds like they want to be more like the Cooper case. Too bad Cooper's transcript isn't even back yet.

So that's 5 weeks for the prosecution. 4 1/2 days for the defense and a few hours for the jury to reach a guilty verdict?

Sounds familiar. Just add in a 2 week jury selection, an extra week for the prosecution, and an extra couple of days for prosecution's rebuttal... I do want to know who the judge is going to be.

I don't see a Judge listed specifically for this case yet. Do you? I do see that these are the judges assigned to Wake County for the week of January 16, 2012 in Superior Court.

I don't think that necessarily means it will be one of these. It may be Stephens again, since he did the first trial, and then did the ruling to move the date back. But I don't know the rules about him doing a retrial of a case he declared a mistrial for, and I think he may do ALL the status conferences for Wake.

From NandO

Quote :
"RALEIGH -- Agents with the State Bureau of Investigation retrieved banking records belonging to Jason Young in an apparent search for evidence of a financial motive for the murder of Young's pregnant wife five years ago, according to search warrants made public Thursday.

Young has been charged with first-degree murder in the 2006 death of Michelle Young. His first trial ended in June when Wake County Superior Court Judge Donald Stephens declared a mistrial after jurors informed him they were deadlocked.

Young's new trial is scheduled to start Jan. 17, according to the Wake County District Attorney's Office.

Young and his attorneys will be in court today, asking a judge to give them a file used by lawyers who represented his mother-in-law, Linda Lee Fisher of Sayville, N.Y., in a wrongful death lawsuit. Fisher filed the suit in October 2008, asking that all of Michelle Young's assets and life insurance payouts go to the couple's young daughter, Cassidy. In March 2009, a judge awarded Michelle Young's mother $15.6 million.

Since the mistrial, SBI agents have continued to work the case, searching for more evidence that will link Jason Young to his wife's death.

The investigators filed four search warrants Thursday at the Wake County Clerk of Courts Office. Each warrant was obtained in October to comb through Jason Young's banking and credit records with First Citizens Bank and the N.C. State Employees' Credit Union and his credit card accounts with American Express and Chase Bank.

Michelle Young was expecting her second child on Nov. 3, 2006, when her sister Meredith Fisher found her body on her bedroom floor. The couple's 3-year-old daughter was also in the home.

Investigators did not see any signs of a forced entry, ruled the case a homicide and arrested Jason Young in 2009. The Wake County Sheriff's Office first investigated the case and described Jason Young as being uncooperative with their efforts to find his wife's killer.

Family members told police that the Youngs were struggling financially and that Michelle Young was stressed about their finances, according to the search warrants.

Sheriff's investigators handling the case say that Fisher told them that at the time of her daughter's death that the "heating unit" in the couple's home was not working. Fisher believed that repairs to the heater would cost about $4,000 and that the Youngs had only $4,000 in the bank.

SBI agents say the Chase Bank credit card had a credit line of $6,000 and was opened a month after Michelle Young was killed. Investigators also found that Jason Young had opened a line of credit three months before his wife's death with American Express for $35,000, court records show.

Young was released from Wake County jail after the mistrial on a $900,000 bond.

Also, on WRAL yesterday Judge Stephens commented on the upcoming retrial:

Quote :
"During a routine hearing Thursday, Superior Court Judge Donald Stephens said he expects jury selection to last several weeks because of extensive media coverage of Young's first trial.

He added that he hasn't ruled out the possibility of going outside Wake County to find jurors."

The differences in the coverage and the way WRAL sometimes states things are so frustrating. Nowhere in the WRAL articles from the past two days do they mention the credit lines opened by Jason.

Why is the credit important? It takes a lot of money to fight a custody battle and murder trial all at the same time. That'd bankrupt just about anyone.

And bussing in jurors would be the worst thing that could happen to Young. They would hate him for it.

Oh we definitely don't have all the puzzle pieces yet, but maybe they are going to try and poke holes in the "heat not being fixed in the house due to lack of finances" excuse in order to show premeditation?

I think it's got to be some kind of violation for one juror to petition the other to FDT in the past...

Does not compute with financial troubles at all. AmEx prefers to lend money to people who don't need it.

Have y'all gone to the courtroom yet? Or are you just waiting in the jury lounge? In all seriousness, you really shouldn't post anymore in this thread. If you are placed into the jury pool for a trial, some judges would hold you in contempt for posting online.

Quote :
"RALEIGH -- Potential jurors for the Jason Young murder trial were asked to fill out three-page questionnaires that touched on routine and very personal issues such as their experiences with marital infidelity.

On Tuesday, prosecutors and defense lawyers began the process of selecting the 12 jurors who will decide whether Young, 38, is guilty of murdering his pregnant wife, Michelle, in 2006.

The case has been tried once before, but it ended in a mistrial in June 2011 with eight jurors favoring acquittal and four for conviction.

Young, who has been out on bail for the past 5-1/2 months, looks less gaunt than in his first trial when he was being escorted to and from the Wake County jail with no bail set.

He has pleaded not guilty.

The questioning of potential jurors began Tuesday with Judge Don Stephens asking about child care issues, work hardships, obligations for college students and planned events.

Those who remained after consideration of those issues were sent to a jury room in the courthouse to fill out questionnaires that went beyond the basic questions of addresses, occupations and family situations.

There has been extensive publicity of the case in which Michelle Young, pregnant and 29, was found bludgeoned to death in November 2006 in the master bedroom of her home. Her toddler daughter was alive in the bedroom when the body was discovered.

The coverage continued three years later when Jason Young, a prime suspect in the case for years, was arrested and charged with first-degree murder in the case.

The trial this past June was broadcast live on the Internet with video feeds and numerous news accounts. .

Stephens instructed the men and women in the jury pool not to search for any information about the case and to keep an open mind, that any evidence they would be asked to consider would be presented at trial.

Jurors will be questioned individually over the coming weeks in a process that often resembles a series of awkward job interviews or blind dates.

Given the accusations of domestic violence and marital infidelity associated with the case, the judge informed potential jurors that some of the questions might be personal and probing about their experiences with such issues.

The trial is expected to last a month once the presentation of evidence begins. That won't happen before Feb. 6,Stephens told the potential jurors.
