haha no. i almost added that i am wearing a bra when i posted it because i KNEW you would comment on it! that was just the closest picture i could find to the dress i'm wearing. i think it is the same dress. it is at least the same designer. not the same color. and again, i am wearing a bra. haha.

^ well i'm done with college and now i live in greensboro. well right now i'm living in raleigh for the summmmer. after grad school, i don't know. wherever i get a job i suppose haha

What do you think about the (potential, and very probably) fact that the Supreme Court is about to rule against the appellate court opinion of its newest member, and amend the Civil Rights Act, all at once with their decision on the Firemen case? Other than the fact that it is a judicial headache?

Do you think Sotomayor's opinion (while she was on the second appellate, ruling for the state against the firemen) could extrapolated as "racist?"

What about the Clean Water Act? Do you think the SC will vote to restore the act to its original purpose, before the farming industry and special interests that simply didn't want to pay to clean up their water pollution forked it all up?

oh my god

well i don't know the best answer to your questions. it is a massive judicial headache. i think the best line to summarize the ENTIRE thing that i've read is "damned if you do damned if you don't." (i think that was from our good old friend Souter - fittingly i suppose). i mean either way, one group of people was going to be angry right? either the minorities were going to say the test was flawed to disadvantage them or the white people were going to be like oh blah blah blah using race as a preferential hiring criteria. which then pisses off conservatives who are already against affirmative action and using race as a plus factor. plus it is kind of hard to draw the line between a term like "plus factor" and "preferential" (but that is a whole other debate).

and second, yes, i think it could be seen as racist. that is one of the big problems - it can seen as racist. i think anything, if you infer enough, can be made to seem racist. but i think that is the problem--people are inferring a lot here. i think the big issue is that the 2nd just affd w/o much reason, which made everyone even angrier (because everyone wants a reason!). and so now people are saying things like she "reads racial preferences and quotas into the Constitution, even to the point of dishonoring those who preserve our public safety." i mean, that is a little ridiculous to me. but i don't know, it is just a mess. anytime there is a case where race is a factor (whether it should or shouldn't be) drama unfolds. and obviously the timing isn't exactly great for her.

what do YOU ^^^, ^^ think?

and i don't know about the Clean Water Act. i haven't really been following.

Many are so capable. As Judge Cedarbaum pointed out to me, nine white men on the Supreme Court in the past have done so on many occasions and on many issues including Brown.

However, to understand takes time and effort, something that not all people are willing to give. For others, their experiences limit their ability to understand the experiences of others. Other simply do not care. Hence, one must accept the proposition that a difference there will be by the presence of women and people of color on the bench. Personal experiences affect the facts that judges choose to see. My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.

I also hope that by raising the question today of what difference having more Latinos and Latinas on the bench will make will start your own evaluation. For people of color and women lawyers, what does and should being an ethnic minority mean in your lawyering? For men lawyers, what areas in your experiences and attitudes do you need to work on to make you capable of reaching those great moments of enlightenment which other men in different circumstances have been able to reach. For all of us, how do change the facts that in every task force study of gender and race bias in the courts, women and people of color, lawyers and judges alike, report in significantly higher percentages than white men that their gender and race has shaped their careers, from hiring, retention to promotion and that a statistically significant number of women and minority lawyers and judges, both alike, have experienced bias in the courtroom?

Each day on the bench I learn something new about the judicial process and about being a professional Latina woman in a world that sometimes looks at me with suspicion. I am reminded each day that I render decisions that affect people concretely and that I owe them constant and complete vigilance in checking my assumptions, presumptions and perspectives and ensuring that to the extent that my limited abilities and capabilities permit me, that I reevaluate them and change as circumstances and cases before me requires. I can and do aspire to be greater than the sum total of my experiences but I accept my limitations. I willingly accept that we who judge must not deny the differences resulting from experience and heritage but attempt, as the Supreme Court suggests, continuously to judge when those opinions, sympathies and prejudices are appropriate.

There is always a danger embedded in relative morality, but since judging is a series of choices that we must make, that I am forced to make, I hope that I can make them by informing myself on the questions I must not avoid asking and continuously pondering. We, I mean all of us in this room, must continue individually and in voices united in organizations that have supported this conference, to think about these questions and to figure out how we go about creating the opportunity for there to be more women and people of color on the bench so we can finally have statistically significant numbers to measure the differences we will and are making."

I basically agree with everything you said

and the Clean Water act is going to be voted on in a few weeks and I have no idea how it's going to go. I'd like to believe they'd get it back on track, but I think the conservatives are just going to vote in spite, no matter how much sense clean water makes.

why couldn't you eat wings? that is like, 80% of the reason to go did you have fun? did you win?

i was disgusting after the fashion show. so hot. so sweaty. so sticky from small children. so heinous from the copious amount of makeup and hairspray. not to mention the edward scissor hands hair style. there was one place and one place only i felt safe to show my face. and that was obviously jackpot.

i think it changes. right now i like green. but not all shades of green. for example i hate seafoam green. but i love a good avocado green. and i like kelly green

i know

i didn't eat lunch today and now my stomach has that feeling...you know the gurgly one where it feels like it is digesting itself because it is so hungry and it is kindof nauseating and makes you NOT want to eat because you feel kind of ill from not eating for so long.

that is how i feel. and i know what would make it feel better. wings. wings would make it feel much better!
