got a question.
I got a ticket back in 2007. Had a lawyer take care of it... but I don't know exactly what he did nor do I have the contact information for the lawyer. Pretty sure it wasn't PJC or a reduction or change to non-moving since there's nothing on my driving record that I can see, so am I in the clear? Did he just get the DA to drop it?

Just got a speeding ticket in DC. It was a photo enforced radar that snapped a picture where you can only see the back of my head . How should i proceed? It is just a citation...no points. The fine however is $250.00 I live here in the NOVA area, so i am inclined to plead not guilty. Oh, btw...the back of the ticket says if you were not driving, they want you to pin the ticket on "the driver" and they will forward the ticket on to them.

he most likely got it reduced to a non-moving violation, which is about on par with an expensive parking ticket. you can go get all the tickets you want, as long as you get them all reduced to NMVs.
If he put you in for a PJC, (a) I hope it was a really severe speeding ticket, or that was a waste, and (b) yes, then you have to keep a clean driving record for 3 years, or you get hit with both.
option "c" is that he got a bad speeding ticket reduced to 9-over, in which case it's still on your record, but your insurance company isn't allowed to charge you extra for it, unless you get another ticket (even a 9-over ticket) within 3-years, in which case they charge you for both. 8/21/2010 1:20:56 PM |

Unfortunately for you, Wake County doesn't do the "improper equipment" thing or generally reduce speeding tickets to any other non-moving violation. I have had Mr. Crouch pull some creative stuff where he had an offense (illegal right on red, if I remember correctly) dropped as a moving violation and written up as the same offense, but as a city code violation (i.e., like a parking ticket). Not gonna happen with that speeding ticket, though.
If you can get it reduced to 9-over, though, that wouldn't be too bad. You might just try going to court yourself and seeing if they'll give it to you, unless Mr. Crouch thinks he can make it go away completely. So I just got a ticket for 80 in a 70 in Emporia, VA. The cop hands me the ticket, but tells me that it's not reckless, and if I take it to court, he'll speak on my behalf (I have no prior tickets, clean record, etc).
If I call a lawyer in VA, is it likely they'd be able to just get this dropped without me having to drive the two hours up there? Also, if I don't get it dropped and just send in the fine and court costs, will it affect my insurance in any way? 1/3/2011 9:32:58 AM |

Just thought I'd give Crouch more props. GF got a second speeding ticket a year ago for 70 in 55 down that nice open stretch of NC55 south of Apex. Told her to go to Crouch and pay whatever he wants because I've heard he's good. About 6 months after the court date she mentioned she never heard back about it so I got concerned, called him up, and spoke to one of his paralegals. It turns out he had asked for a continuance about 4 times and was waiting on the right judge to come up on the docket for that day to contest the ticket. It got dismissed a few months later and that cat called me directly to let me know about it. He asked how I had heard about him and told him from Tdub, he said it's been a nice boost for his business around there.

I had some bad luck following Easter. On the way home a state trooper pulled me over for speeding on the beltline, and even though I wasn't rude or anything to him, he didn't reduce the ticket at all, and I got charged with going 77mph in a 60 mph zone. (I also didn't admit any wrongdoing in case we were being recorded, merely said I was sure I wasn't going as fast as that.)
Unfortunately this isn't my first offense in 3 years. In Dec 2008 (hearing was Jan 2009) I had another ticket, and they reduced it to a 9 over violation at the check-in desk before even entering the courtroom.
I found if it doesn't get reduced I could have my license suspended for being 15 over, and I also hear I shouldn't waste a PJC on it. So what is the advice? I want to know 1) is there ANY WAY it will get automatically reduced like last time, and if not 2) should I get a lawyer, because I don't exactly know how to contest a ticket in court and I don't want things to get worse (the last judge when I was there acted like a mega-bitch).

I had a similar situation. Crouch hooked me up and said that if the prior ticket date wasn't three years ago yet, he will continue/delay the case until it is 3 years later
My previous ticket had also been reduced, 67 in a 55, and the next one (problem one) was also over 9 over. I can't remember what exactly he did though, but it worked.
At the very least give him a call. He deals with speeding tickets all the time and will listen to you for free, and even call you back if he is out of the office.

Yep, Wake County is a little tougher than some places (i.e., they aren't as easy to reduce things to non-moving violations), but Crouch can probably help you. I'd say that continuing it until the other ticket becomes non-chargable (at the 3-year mark) might be a good option. Crouch is hardly your only option, but I've had good luck with him a couple of times, and BigBlueRam would have lost his license many times over without him. He's not a magic bullet, but he's a known-good quantity.

Thanks for the advice everyone. I called Crouch's office Tuesday and he got back to me early this morning. He told me the two options he could do (his preferred one or the one he'd do if he's not allowed to continue the case until the 3 year mark is up), but either way I won't have to worry about my insurance going up. Appears the fine is $25 and the court costs are $190 I know generally if you just get it done and show up at the courthouse with a current registration they will typically waive the ticket. However, will they also waive the court costs are am I gonna pay those either way?

Happened to me twice with cars and once with a jet ski (ticket from the game warden). In every case, I either showed up at court with proof of proper registration, or just went by the courthouse (DA's office and spoke to secretary, I think) and it was immediately dismissed at no cost.
(before you guys get the idea that I'm too dumb to keep my shit registered, (a) I've had a bunch of stuff to keep up with at times...once as much as 2 cars, a truck, 2 motorcycles, and a jet ski...and (b) they were all unusual circumstances:
-My Jeep in college...registration expiry notice went to my parents house and they didn't open my mail. I passed a Pullen Park cop on Avent Ferry doing about 5 mph over, and he must have had the tiniest pecker in the world...pulled me over and launched into a speech about how I had to respect him even though he wears a Pullen Park uniform, haha. I guess he felt less ridiculous writing me a ticket for my registration being out by like a month than he would have for writing me a speeding ticket for 45 in a 40.
-My truck's registration expired while I was deployed somewhere. When I got back, I went to renew it, but there was a block on it, because my annual vehicle tax was also unpaid (again, I'd just gotten back from Iraq or Afghanistan or somewhere). I paid it, but it took 2 days or something before the block got removed, and the day before I would have been able to renew the registration, sure enough I got a ticket for it. The worst part is that I later found that i was exempt from the tax due to being AD military and not a NC resident, even though the truck is registered here. Well, no, the worst part was that it played a part in negatively impacting me professionally, but that's another story.
-Had my Waverunner repainted and some mechanical repairs done to it. All of the registration and stuff was legit and current, but obviously the old registration sticker and NC side #s had been removed for the paint job. I had the foresight to order a replacement registration sticker, and when I got it out the shop, I stopped by West Marine to get some side #s, but they were closed. Well, it had been in the shop for 8 months (another long story), and I couldn't resist taking it for a test ride. Sure enough, I ran across a fucking Barney Fife of a game warden, who--even when he checked and found that all of my paperwork was current, and after I told him that I'd just gotten it out of the paint shop less than a day earlier, still found it necessary to give me a ticket for failing to display NC side #s on both sides of the vessel. Part of me wishes I hadn't stopped...his chances of catching me would have been 0%. On the other hand, all it really cost me was a couple wasted hours waiting around in court.8/23/2011 2:45:09 PM |

^I believe you can motion for a continuance in advance of your court date. Just make up a good reason.

there's no need. if you're going to bother with talking to them ahead of time, you can probably just get them to throw it out before ever going to court. Even if you go to court, you'll never even talk to the judge...you'll show your renewed registration card to the DA, and that will be that. I got a registration violation and a lapsed inspection in Goldsboro 4th of July weekend last year. If you have an opportunity to go by and talk to the DA beforehand, it may save you time rather than going to court.
When I showed up, I handed my papers to the bailiff and had a seat. It was 30 minutes of waiting for other people to handle their problems before they called my name. I showed the inspection and registration and walked out of Wayne Co. Superior Courthouse for free. 8/23/2011 5:58:01 PM |
