The thing is, if its not premeditated, then what little the prosecution has is gone. Second degree murder is absolutely impossible in this case.

video showed her not wearing it at the teeter day of, but i have not seen anyone testify that she had it on at the party, but i missed a lot of the early on testimony.

^ but once the cops find the body, i think, if you are not guilty or say a drunk driving case then the family (he or the parents) would receive both the earrings and necklace back after sometime.

i would think the jewelry would be given back to him or her parents. i don't see why the police would need to keep it as evidence forever.
