from page 11

I don't know if ya'll will be able to see these pics, but if not I'll re-link them

living room before:

living room after:

these were the most recent pics that I happened to find on my iphone, just showing that the beer shelf was tasteful and not just like a rando trash collection, it did have over 200 bottles and went around the perimeter of the entire room/kitchen. I had other stuff on the shelves too like jars of malted barley, hops, etc. as well as a section of the shelf with my favorite pint glasses from beer festivals (all of which were shattered, none spared)

Small Claims court for the amount of the security deposit plus legal costs.

http://web.co.wake.nc.us/courts/smallclaims.html

I would send him a demand letter (certified mail) that highlights the photographic evidence you have first and explains why you did not damage the property that there was a vehicle that knocked it over and see if he pays.

If not file on him and have him served, do it now while everything is fresh in your memory and you are hot about it. He is already going to collect money for damages from the insurance company no reason to charge you for damage you did not cause.

I think Mr. Perry is in need of large quantities of condoms and porn delivered via the United States Postal Service, or UPS to his doorstep.

Phone numbers and email addresses are always welcome as well.

I'd recommend large quantities of good faith attempts to resolve the financial matter followed by large quantities of papers served for small claims court.

\/ Good call.

^That's Anthony B Perry Jr, not Anthony W Perry Jr.

But really, who doesn't enjoy free condoms?

Haha, by the way...If I hadn't seen the BEFORE photo, I'd have thought you'd just thrown one hell of a party the night before...A party with a greater beer selection than any I attended in college.

I do have a keggerator in the next room and I've been known to have small gatherings from time to time, always with choice beverages

Yeah my landlord is Tony Perry but I don't advocate said illicit activities haha man tww action team is a powerful entity

oh and drunk driving doesn't deserve a mms of one year, that's absurd even in a situation like this. She should get a couple weeks or something since property was damaged and there was a high potential for death. Oh and my dog was hurt but nay on the year time. Hell, if I were the judge I'd still have a tough time giving her a month I mean she made a young, dumb mistake but then again she obviously hasn't learned from it getting a bottle the next day but then again most judges don't have tww action team to expose such things haha

You do realize that it was only dumb luck that kept her from killing anyone? You know, as in dead; as is a family destroyed.

...well considering that this is my thread, and my house that was hit -- yes I do realize how close she came to killing me and how close she came from destroying my family

but the fact is, she didn't and a year is a lot for that, granted these are exceptional circumstanes. A guy from my high school robbed a bank with a broken gun, ran from the police, crashed his car into a house (no real damage) and got a year. This comes nowhere close to that, though I'm greatful for us both that nothing more happened.

I'm flabbergasted by your response. We're not talking about some girl who blew .085 on a breathalyzer. We're not talking about somebody who swerved slightly in traffic. We're not talking about somebody who had shitty luck and hit a checkpoint.

We're talking about someone who went into the lane of ONCOMING TRAFFIC and then CRASHED INTO A GODDAMN HOUSE at a rate of speed sufficient to KNOCK IT OFF ITS FUCKING FOUNDATION.

There's "youthful mistake" and then there's "holy shit this lady is a threat to herself and others."

I dunno, a year seems perfectly reasonable to me until we develop technology that immediately renders an offender unconscious when they hit the legal limit.

Yeah if it were me I'd be happy to let them throw the book at her. She was reckless and shows that her recklessness causes zero remorse. If this is how she acts after an accident to this extreme, I give it five years or less before she kills someone in a DUI accident.

I hear you. But let's keep things in perspective here. She didn't hit a car or a person or some other moving, relatively small target.

She crashed into a house.

Generally such an outcome requires a level of dedication to the art of drunk driving that few can ever truly reach.

Hey man, that house ran right out in front of her and there was nothing she could do. Even with going 35 in a 40 mph zone on her way to church and her kids in the car, it was unavoidable.

haha well like I said I'm forwarding the twitter stuff to the prosecuting attorney, so it's in the courts hands now, I couldn't really care less what happens to her so long as she's in a position to repay my monies

anyone know how much carpet depreciates in rental property in NC? my landlord is trying to charge $850.00 for all of maybe 550-600 sq. feet of carpet. I lived there 3 and a half years or so, and the carpet was installed in 2002, so that makes it about 7.75 years old, not to mention all the broken glass in it from the accident. He's trying to get me to pay for the whole thing, but there has to be some depreciation right?

i kno right! haha but yea seriously that's what he's doing. the deal was that I found the house in 2006 and the guy was selling it but wanted a renter so that the sale would be easier, so he let me rent for under market value at $700 and locked me into a lease with the new owner, which entailed that after the terms of the lease I'd go month to month as long as I wanted, so I lived there 3 more years and now he's using the accident to fix the house up, double dip by charging me and the insurance company, and kicking me out for no reason other than he wants to jack the rent up

fucking chode.

I'm not certain, but I'm pretty sure if you had a pet in the rental, then they have to change the carpets after you move out anyways, especially after three years. Don't quote me on that, but it's unreasonable to stick you with carpet charges.

im pretty sure NC tenant laws say the life of apartment carpet is 7-8 years. you will only have to pay for the remaining life of the carpet. dont quote me on this, but im pretty sure renters get a tax deduction for depretiation on walls and carpets of their rental properties.

I'm pretty sure NC tenant laws shouldn't matter SINCE A CAR KNOCKED THE HOUSE OFF ITS FOUNDATION.

I'm not even sure why you're talking to the asshole still. I would hire a lawyer and tell him he can direct all communication to said lawyer.

which is precisely why she needs at least a year of jail-time. She hasn't figured it out yet, dude. Almost killing someone didn't teach her anything...

and yeah, call a lawyer. This landlord is seriously sounding like a douchebag. You might even want to call *CLANG* Lewis and DAGGETT. *CLANG CLANG* They mean... BUSINESS.

Read the security deposit page, you can not be charged for normal wear and tear. If you had cigarette burns and stains in the carpet its one thing, if its just worn they cant charge you for it.
