i mean fire it into a crowd and tell me that it isnt a WMD
but i mean i feelwhat youre saying...a crowd v.s. like a city or a region
but i mean part of that stems from the fact that we make our own interpretations of what "mass" means instead of going by what saith the law and/or precedents
personally, i have no problems considering a sawed off a WMD...its just that "WMD" has a severe stigma do it associating directly with warfare 8/1/2008 12:32:13 PM |

Quote : | "Woodall said during the hearing that Atwater and Laurence Alvin Lovette Jr., the second suspect charged, told various people they were in the area of Rosemary Street near Carson's home on Friendly Lane in the early-morning hours of March 5 looking for someone to rob.
Carson had told friends she was staying home to do work. Evidence showed she opened an e-mail on her computer at 3:35 a.m., Woodall said.
"Essentially, they walked up Friendly Lane, they could see a person in that house, and the blinds on the windows of that house were raised that morning," he said. "And the state contends that Eve Carson was working at her computer just in front of those windows."
Woodall said Atwater made various statements about what happened next. In one statement, Atwater said he and Lovette went into Carson's house and abducted her. In another, he said they acted as if their car had broken down and took her from outside her home.
"Based on the appearance of her residence, the state, at this time, believes she was probably abducted just outside her home," Woodall said.
Investigators determined that the suspects used Carson's ATM card shortly before 4 a.m. at a Bank of America in Chapel Hill and then at other locations in Durham to withdraw about $1,400.
Woodall said they took Carson back to Chapel Hill to Hillcrest Drive, where police found her body hours later. But there were no clear statements about what exactly happened next, he said.
Carson was shot five times, including once in the head with a shotgun. Woodall said investigators believe Lovette used a .25-caliber handgun to shoot her four times and that Atwater used a 12-gauge sawed-off shotgun.
Although he did not say when or where, Woodall said that the suspects disposed of the weapons and that when investigators recovered them, the handgun was broken into pieces and that there appeared to be attempts to dismantle the shotgun.
Physical evidence linked Lovette to Carson's Toyota Highlander and Atwater to the shotgun, Woodall said." |

Quote : | "Eve Carson murder suspect indicted on federal charges
Greensboro, N.C. — A federal grand jury has indicted one of two suspects in the slaying of UNC-Chapel Hill's former student body president.
Demario James Atwater, 22, was indicted Monday on a charge of carjacking resulting in death, which could allow federal authorities to seek a death sentence.
Chapel Hill police have charged Atwater, and Laurence Alvin Lovette Jr., 17, with first-degree murder and kidnapping in connection with the March 5 shooting death of Eve Marie Carson, 22, of Athens, Ga.
Police investigators believe Atwater and Lovette kidnapped Carson and forced her to withdraw $1,400 from ATMs before shooting her five times, including once in the head, with a .25-caliber handgun and a sawed-off shotgun.
Federal authorities began looking at the case in April to determine whether to file federal carjacking charges, which can carry the death sentence if prosecutors can prove the crime was committed during a homicide.
U.S. Attorney General Michael Mukasey must approve seeking a death sentence in the federal case. Prosecutors said Monday he has yet to do so.
Orange County District Attorney Jim Woodall has said he will seek the death penalty against Atwater, but juries there have rarely sentenced defendants to death row.
Lovette is ineligible for the death penalty under a U.S. Supreme Court ruling because he is under age 18 at the time of the crime of which he is accused.
Death penalty cases are rare in federal cases, according to former federal prosecutor Dan Boyce.
Since 1977, there have been three cases where federal prisoners have been executed, including Timothy McVeigh for his role in the April 19, 1995, bombing of the Alfred P. Murrah Federal Building in Oklahoma City." |

Hillsborough, N.C. — Eve Carson's parents say their daughter did not support the death penalty – and neither do they.
But Orange County prosecutor Jim Woodall says that despite their beliefs, they support his decision to seek the death penalty against one of the two suspects charged in her death.
"I am aware of their position, and I respect it immensely," Woodall said. "They've also said they support me and what I feel I need to do to prosecute this case."
The district attorney announced in August that he plans to seek the death penalty against Demario James Atwater, 22, who is charged with first-degree murder and kidnapping in connection with Carson's death.
Police found the 22-year-old University of North Carolina at Chapel Hill senior dead in the middle of a residential street near the UNC campus while responding to gunshots in the early-morning hours of March 5.
Investigators believe Atwater and another man, Laurence Alvin Lovette Jr, 17, kidnapped Carson and forced her to withdraw $1,400 from ATMs before shooting her five times, including once in the head.
Atwater also faces federal carjacking charges, which could also allow federal authorities to seek a death sentence.
Lovette can't be executed if he is convicted in Carson's death. A 2005 U.S. Supreme Court ruling prohibits anyone who was under the age of 18 at the time of a crime to be executed.
No one has been sentenced to death in Orange County since North Carolina reinstated the death penalty in 1977. The last person executed for a crime there was in 1948." |

what the fuck does that matter? Since when is it the decision of the victim as to how the crime is prosecuted? The law is the law, regardless of what the victim thinks/thought10/28/2008 6:19:11 PM |

it matters because....
the death penalty is only an option and not mandatory. its not like she had something against jail.
add the fact that prosecutors usually let victims have a say in the weight of the sentence, it's really not a huge jump to say that they should respect her opinion. (and yes i know she can't have a say because she's dead, but her position was made clear during life)
anyway, i'm not gonna sit here and argue with blood-thirsty rednecks all night. it's pretty obvious what should be done here. i say respect the wishes of the people who were actually hurt by this...

i'm really not trying to be a dick when i say this, but maybe you should read up on NCDOC and all the different inmate evaluations and classifications, and the different levels of secure custody.... the color coded jumpsuits and all that.
not only is it kinda interesting, it will explain a lot about what general population for the average prisoner is - and how they keep violent offenders (close custody) away from "weaker" offenders. it goes from dorms full of people who can freely roam all the way to one man to a cell lockdown
you also might want to look up deaths in NC due to inmate on inmate violence. you're pretty much more likely to die in a car crash than you are from serving time in DOC custody.
using the death penalty to "prevent more violence" is a stretch10/29/2008 11:29:40 AM |

EVen if she bought them off of a frat boy frat boys aren't full fledged dealers and answer to someone. If said frat boy was giving them to her on credit and she wasn't able to pay then pressure gets put on fratboy. Fratboys tells them the truth to save face and they deal with Eve first hand. Eve promises to pay and drags it on thinking "they can't mess with me" possibly even tells them fuck off and at some later time this event happens.
