what i thought was amusing was WRAL running a whole segment on people that have been wrongly convicted in the news the night of the conviction

^^^^^ Wow, if that is actually true and not just someone begging for attention (which I don't see as the case since it's in the anonymous confessions thread), that is really really bad. What's worse is the CPD and Town of Cary are putting out these public statement about how great of a job the CPD did. As a Cary resident I question if I can even trust the cops in my town anymore. Corruption, ineptitude and cover-ups of this magnitude are things you see in movies in places like NYC, not in little ol sweet Cary.
^^^^ I've been itching to do the same thing. My daughter has a good friend at school whose mom is a lawyer at the AG's office. I'm sure she has some good scoop on this, I'd like to hear a professional's opinion on the matter. Based on what you said, it sounds like the prosecution convinced Gessner that they had a strong case to present so he was lenient with them as far as trying to give them a fair chance to present damning evidence. I wonder if in hind sight he really regrets some of his I'll allow it's and suppression of testimony, because he just played a major role in costing BC at least 2-3 years of his life. 5/6/2011 10:06:57 AM |

Yeah, might as well go ahead and send this one to the Innocence Commission, although I don't know if they do anything with reasonable doubt or only work with proven innocence. Gessner's reaction is confusing but perhaps it may stem from the fact the google map "evidence" was the most damning at the end and he was responsible from preventing the defense expert from refuting it. He bent to the will of the jury to speed up the trial, except he sped up one of the most important aspects of the defense and now someones is convicted of first degree murder. Maybe he was having second thoughts on allowing everything. 5/6/2011 10:07:19 AM |

Quote : | ""I'm closely connected to the BC murder trial, from the prosecution side. I can honestly say the following:
1. The reason why the prosecution took so long with its case was to wear down the jury so that they would be too exhausted to really pay attention.
2. A portion of the prosecution does not think he did it but were directed to win this case at all cost in order to save face for the police department.
3. The google maps defense didn't stand a chance. The prosecution understood that, in today's climate, jurors, especially black jurors, are likely to believe in setups by the police department. This counter-evidence didn't have a chance of getting admitted.
4. In jury selection the defense had a lot of people they liked but the prosecution asked questions about if they could participate in a "extensively lengthy trial" and this forced those that the defense liked to step down. Had the defense not excused the ones they did the jury would have had 0 men and would have been a mixture of poor black women and very wealthy white women. "" |
I'm sorry but if this is true and you don't come forward and help exonerate this man then you need to hang yourself, whoever you are5/6/2011 10:09:24 AM |

It was said that several jury members were crying as the verdict was read. Why?
1) they thought not guilty but were swayed in deliberations? 2)they got emotionally wrapped up on NC side (which would show they based verdict on the emotions of it). 3)^same but bc side which makes me think ^^ was the case.
Also, when has a judge ever done that while reading the verdict. 5/6/2011 10:19:55 AM |

Agreed. If I has any kind of info or was in any way remotely close enough to this case to provide the slightest shred of proof that this trial was mishandled, I would get it to the right people at all cost. I was and still am very bothered by the thought of BC sitting in that jail cell for the next 2+ years waiting on an appeal when this trial presented plenty of opportunity to actually prove his guilt or innocence.
Instead you have a handful of unethical lawyers covering up for inept police at the expense of this guy's life. Having two young daughters of my own, I can't come close to imagining how painful and heartbreaking it would be to be stuck in prison without a chance to ever see them. I hope he's exonerated in the appeal and manages to sue the TOC and CPD to the tune of millions. 5/6/2011 10:25:56 AM |

It's already been said, but I feel the same way: whoever that was saying that in the anon confessions thread needs to grow a pair and do the right thing, EVEN IF it means losing your job and/or something worse.

from the NC Innocence Commission's website:
http://www.innocencecommission-nc.gov/faq.html
Quote : | "FREQUENTLY ASKED QUESTIONS
What cases do we take?
All of the following criteria must be met before an innocence claim may be investigated:
1. Conviction must have been in a North Carolina state court. N.C. G.S. 15A-1460(1). 2. Conviction must be for a felony. N.C. G.S. 15A-1460(1). 3. Applicant must be a living person. N.C. G.S. 15A-1460(1). 4. Applicant must be claiming complete factual innocence for any criminal responsibility for the crime. N.C. G.S. 15A-1460(1). 5. Credible evidence of innocence must exist. N.C. G.S. 15A-1460(1). 6. Verifiable evidence of innocence must exist. N.C. G.S. 15A-1460(1). 7. Claim must not have been previously heard at trial or in a post-conviction hearing. N.C. G.S. 15A-1460(1). 8. Applicant must sign agreement pursuant to ยง 15A-1467.
Who can initiate a claim?
Anyone may initiate a claim. Most claims are initiated by the convicted person, but many come from a friend or a family member of the convicted person. Claims may be initiated by a witness, victim, law enforcement officer, defense attorney, or anyone that has new information about evidence of innocence. Once a claim is initiated, we will contact the convicted person and only pursue the case if they choose to cooperate with us.
How do I initiate a claim?
There are no specific forms for initiating a claim. We ask that you send us information in writing about the case and the new evidence of innocence. Please be certain to include information about the conviction and the evidence used in supporting that conviction. Detail the new evidence of innocence and how we would be able to look further into that evidence. Be sure to include contact information for yourself and the person that was convicted. We will then contact the convicted person and any other people that are necessary in order to follow up on the claim.
How long will it take to process my claim?
There is no definite answer. Different cases take different amounts of time to investigate and have evidence tested. Please look at the Case Progression Flowchart to see how the cases are processed.
What if there was an error in my trial?
The North Carolina Innocence Inquiry Commission was created by the legislature to investigate cases where new evidence of complete factual innocence has emerged since conviction. We do not review technical or procedural trial errors. Please see our North Carolina links page for other organizations that may be able to help you. " |

I just could not sleep well last night, I was so upset.
But I just want to say, every time someone in this thread says, it's all due to the women on the jury, or we never should have gave them the vote, etc it kinda pisses me off. Like I know it's true that women on a jury can be like that but I just wanted to say that I'm not. I'm also pretty damn stubborn so if I know there is reasonable doubt, there is no one in this world who could make me change my vote. I just wouldn't budge. 5/6/2011 1:44:51 PM |

At least one eyewitness came forward on several occasions to the Cary Police with significant information. She was ignored until, out of frustration with the lack of response, she brought her information to us. Only after we took it to the Cary Police, did they finally take her seriously. He said Gessner kept telling him the state was going to produce some good evidence over and over....but it never happened. He is also fairly certain (as we all are) that BC will get his appeal and that's where he'll get his justice.
